Thanks. I thought Scotus had already ruled, and figured a Freeper would soon post it.

Looking at the bigger picture, do we live in a republic if unelected blackrobes write, rewrite the constitution and congressional, state laws at their whim?

The modern purpose of congress isn't to craft laws on our behalf, but rather to rubber-stamp regulations and nominations from the executive branch.

Elections are increasingly courtesies extended to a dimwitted public, so as to make us think we live in a free nation.
