Apple could use its private resources to build a software tool update to install on phones of that (5) generation. It would update the system software, eliminating the locking. If they did this, it could be used on all iPhones of that generation. Millions.
I support their decision to take this through the legal system. The government has no constitutional right to access private data or to force a company to use its private resources to work for the government.
I wonder if this is the fbi using a high profile case to try to change the law.
In generation 6, this approach would not work because the encryption is built into the processor chip.
That is an incorrect characterization of it. If a private company refuses to write such code, that is because they cannot, because an update requires a valid Apple signature, and nobody else can create one.
It's analogous to a safe company being told by the FBI, every safe you make must have a key that you must give to us.
That is nonsense that does not conform to the facts at all, so far as I have been able to determine. Unfortunately it is getting repeated all over the D@mned internet, and before it's over, everyone is going to believe it.

Self-erase after 10 failed attempts, actually. Easy enough for the FBI to get around. Make a disk image of the encrypted data on the iPhone. Attempt a brute force attack. After 10 attempts, the clone image self destructs. Repeat another brute force attack with the next cloned copy. The government does not need Apple's help.
Totally wrong. Apple does not have the information and they do not own the phone. The gov can’t force a third party to conduct a search. Apple has nothing to do with this crime
The phone in question is not an IPhone 6. It is an IPhone 5.

They are not being asked for the decryption key. They are being asked to update the firmware to remove the number of password tries limitation, and the time delay limitation for password entry.
They are to be allowed to maintain custody of the phone until a brute force technique unlocks it.
So, to use Apple’s reasoning, I should be able to keep all my information that they may want in a desk drawer and tell then it is a privacy issue and no court will let them seize it.
Just because the container is electronic should make no difference in the ability of law enforcement to access it.

Imagine you are just a good ole Christian Conservative in a country that has shifted heavily socialist. Perhaps a liberal who doesn't like you pulls a few strings and has you arrested for a trumped up charge (traffic stop and they claim you resisted arrest). Now they have the code to unlock your phone. You happen to mention to a buddy that you have put up a stash of guns and ammo in the woods in case a SHTF scenario occurs in the future. Boom you are arrest for terrorism.
I see my version as more likely to occur.

If you get a warrant for something that does not exist, you can say, sorry, that does not exist. Nothing in the constitution says you have to invent it, and produce it just because FedGov demands it.
Apple explicitly made i6 to have crypto that even Apple can’t crack. If FedGov is so concerned, they could have banned sale of this cellphone before they were distributed.

The FBI has asked Apple to update the firmware of this particular phone to remove the "number of tries" limitation, and the time delay limitation between tries.
The hardware is capable of doing a new password check attempt every 80 milliseconds, therefore it can be queried with a new password 12 times per second. From an asserted expert's opinion on the topic:
Even though this 80ms limit is not ideal, it is a massive improvement from guessing only one passcode per hour with unmodified software. After the elimination of passcode delays, it will take a half hour to recover a 4-digit PIN, hours to recover a 6-digit PIN, or years to recover a 6-character alphanumeric password. The recruiting value? What the hell is that? You sound like the Democrats who say that every statement out of Donald Trump's mouth is a recruiting tool. The contents of the phone memory are encrypted. The communication between phones is not. Apparently, we need to have unencryted communication and unencrypted memory just in case some jihadists decide to do what they think their religion tells them to do. We already get felt up at the airport, there are cameras everywhere, and the NSA has all the metadata. Now, if you own an Apple device, you can't have any privacy so that one terrorism event every 3 or 4 years that kills a couple dozen people can be prevented, even though the event already happens by the time they get around to wanting the information.
I don't want to open my door every time some bureaucrat wants to make sure there is no jihad going on at my house. There already isn't. So every embarrassing thing that I text to my doctor, or any communication with my spouse, or all my banking transactions are fair game just to be sure no laws are being broken. But we aren't talking about laws, we are talking about jihad, which I guess is something that makes it so legal protections are an obstacle to preventing it.
