James Damore has an 'above decent' chance of winning his legal case against Google

An expert in California labor law tells Business Insider that Damore has a better chance of winning his case than people may think.

That's because Damore's case is NOT about free speech, discrimination, or his rights as an "at-will" worker.

Damore filed under a section of the law that deals with protecting statements made by workers' rights activists who have questions about wages and conditions.

Google has stubbed their LEFT toe.

Google may have difficulty establishing that he broke the company's code of conduct because he used message boards the company provided to allow employees to discuss these issues, and because his manifesto repeatedly states he favors diversity and intended to "increase women's representation in tech."

I bet they’ll settle with him. His case may be the reason why Google cancelled their plans for an internal “Town Hall”-style forum with employees about the issues Damore raised. Perhaps any statements made by Google might’ve been used against them in the coming trial.

He is a smart guy will get a great lawyer to discover that Google tolerated AND encouraged all sorts of kooky left wing messages.

Plus if Dalamore is wrong when he suggests that biological differences may be the the reason we do not see more women in leadership THEN the only other explanation is that Google is demonstrably sexist.

Even if he gets his job back he needs to find other employment.

His career at Google is over. He will never be promoted.

He has exposed himself as a ‘free thinker’

Some poll that was done on Google employees - more than half of their own employees agree with Damore.

It is about whether he was fired because he complained that Google's diversity efforts were unfair to men.

If Damore wins his case, it would present numerous opportunities for others to battle against the diversity effort known as "affirmative action". Isn't affirmative action discriminatory and "unfair" to whites and other non-whites?

I agree. They’ll settle. Google’s management might not see what they did wrong here, but I’d bet their attorney is telling them they’d better settle this before it costs them dearly.

And their PR person? This is a nightmare that could lead to legislation aimed at Google from several directions.

If Damore wins, and he should, it will likely be on grounds that he was unjustly fired without cause and only because management was cowed by the dissent his writing caused, even though management encouraged the discussion in the first place.

The diversity issue he raised will resonate whether he wins his case or not. Google firing him assured that. I wouldn’t be surprised to see legislation tailored toward restraining Google in several ways as a result of their stupid decision to fire him. Not legislation directed at righting the wrong of firing him, but legislation aimed at the whole diversity charade.

Most likely Google will settle. While they have a right to fire anyone that violates their company policies, the statements they made after are hypocritical and troubling.

I believe you are correct. The discovery phase could be devastating for google, particularly if there is truth to Damore's claim that white males are regularly 'shamed' at meetings. Google doesn't want the curtain pulled back on their leftist bigotry. Easier to settle.
