Rebuke of U.S. Attorneys in Cliven Bundy case: "Every prosecutor's nightmare'

The lead prosecutor in the Nevada standoff case against Cliven Bundy, two of his sons and a fourth alleged ringleader told a jury in his opening statement last month that the case centered on the need to respect the rule of law.

Five weeks later, it was the prosecution team's abuse of the rule of law that sunk the case, leading to a judge's declaration Wednesday of a mistrial.

U.S. District Judge Gloria M. Navarro methodically listed the prosecution's six separate violations of the Brady law, which requires turning over evidence potentially favorable to the defense. The judge further ruled that each violation was willful.

If ever there was a time when federal prosecutors needed to make sure they acted with complete integrity it was in the high stakes Bundy case, legal observers say.....

..... whether prosecutors can pursue a new trial, and the judge's finding of deliberate misconduct gives the Bundys a good argument to seek an outright dismissal and walk away free men, legal experts said.

In the meantime, the dissection has begun: How could prosecutors have lost sight of due process, one of the basic tenets of the legal system.....

The judge's rebuke of the Nevada's Acting US Attorney Steve Myhre, the lead, and two seasoned veteran Assistant US attorneys, Daniel Scniess and Nadia Ahmed, was remarkable in and of itself.

"This is every prosecutor's nightmare," said Kent Robinson, a retired federal prosecutor who served six years as chief of the criminal division in Oregon's U.S. Attorney's Office.

When a judge makes a finding of misconduct by a prosecutor, the U.S. Department of Justice's Office of Professional Responsibility investigates and determines if discipline is warranted, which can range from a reprimand to a suspension.......

The folks in Portlandia saw an Oregon jury find two Bundy brothers not guilty last year in connection with the Oregon Standoff protest.

Now they are watching federal prosecution of the Bundy family members and others fall apart in Nevada amid lawbreaking by the federal prosecutors and quite likely others in the Bureau of Land Management and the FBI.

This is the spin from Portland media and reporter Maxine Bernstein of "OregonLive" who's done quite a job of reporting matters in both Oregon and Nevada.

Other media should devote the kind of attention to the story she has.

Wow, another case of more winning. It is great to see the corruption in our legal system having light shine upon it.

Trump’s next campaign slogan needs to be more specific than MAGA or “Drain the Swamp.” Something like, “Prosecute the Corrupt Politicians.”

Some of these A-holes are like the Germany SS. The US best weed out these folks otherwise we'll be invaded in the middle of the night......remember the Gestapo and SS troops. Muller is the Gestapo.....

I'd say a couple folks at the DOJ are going to get fired. I believe a big BLM dude has been fired. Let's see how many FBI folks get taken down with their disgusting behavior.

The problem with these cases is....you can't just say...let me take a look....you need some meat to chew on. Well, this ia one big bear for the DOJ to chew on.

Because Obama acting at the request of Harry Reid, ordered them to.

This is yet another instance of the government being used as a political cudgel. All involved must be prosecuted

The Fed side of it has been really bad ....just the Dan Love piece of it is horrific & there’s FBI special agent Astarita who lied about shooting at Finicum & was indicted, etc., & there was also lying about whether cameras/snipers were at the ranch ..... on & on. Terrible to think this sort of thing could go on in America. I think Sessions/DOJ is going to be very unhappy with what they find when they review the case/prosecutor’s work.

I wouldn't hold him up as a role model. He was pretty sleazy himself. It was Rudy who popularized the "perp walk" which is solely intended to pollute potential jury pools. Rudy was always about his own political advancement and nothing else.

You mean more of will be invaded in the middle of the night. We all know about no-knock SWAT raids (which come up completely empty 2/3 of the time BTW). And for some real Gestapo follow-through, do a search for "Wisconsin John Doe scandal".

The lead on this article should read “.....Every Citizens Protection!”
Prosecutors should have to serve the sentence that they are asking for in any trial where they are found to have maliciously prosecuted or withheld exculpatory evidence.

2) You don’t get it.. Cliven Bundy has WATER RIGHTS to that land.. and he did not Renew his Contract with the BLM because the BLM was reducing his AUM (How they count heads of cattle) to a level that would not allow him to keep his water rights (Nevada has beneficial use rights - these rights are “able to be financed by the bank, like a house”... and you MUST show the STATE OF NEVADA that you are “using that water for the BENEFIT” of something.. e.g. Crops, Cattle, other Livestock — or you lose them - this re-certification is done every 5 years). The BLM wanted him to sign a contract that would reduce his AUM to a level that would not support his STATE Claim of Beneficial Water Rights. NO FEDERAL AGENCY Charged with *Managing* the “land” should be able to “make rules that put you out of business”! They have cattle, their home and their business are ALL wrapped up in that land.. That’s like a Leasing Agent you hired to come “Manage the property you rent out - coming and forcing YOU, the owner out of your own property”?? You are ok with that?? Humm seems like STEALING to me.
