Whats the sentencing guidelines for things that are not a crime?
My prediction: they come to a sentencing deal. They agree that he gets sentenced on the real crimes. In California we would call it a Harvey Waiver- the judge can take the other conduct into account, but he is actually not sentenced for that conduct.
