Kamala Harris And Brett Kavanaugh Had A Very Weird Exchange At His Confirmation Hearing

More than 12 hours into Judge Brett Kavanaugh's Supreme Court confirmation hearing on Wednesday, Sen. Kamala Harris raised a question about Special Counsel Robert Mueller's investigation that appeared to take everyone by surprise.

"Have you ever discussed Special Counsel Mueller or his investigation with anyone?" Harris asked, prompting Kavanaugh to note that the topic is "in the news everyday" and that he had discussed it "with other judges."

Then, however, Harris shifted to a far more direct question: "Have you discussed Mueller or his investigation with anyone at Kasowitz Benson and Torres, the law firm found by Marc Kasowitz, President Trump's personal lawyer?"

And though that question amounted to a near-accusation that the senator never quite made, Kavanaugh also was unable to give a direct answer — leaving the issue unresolved going into Thursday, what will be the third day of Kavanaugh's confirmation hearing.

Nothing about such a communication between Kavanaugh and a lawyer from the Kasowitz firm has been reported previously, and the White House did not immediately respond to a request for comment on the exchange.

This was odd last night.

Harris is a pitbull prosecutor type.

Looks like she's setting up some kind of perjury trap, probably with the intent of impeaching Kavanaugh if he's confirmed.

This is ballgame and all stops are being pulled.

I'd love to hear Judge Kavanaugh make some kind of reference to Willie Brown while being questioned by this little bit of fluff.

Trap question and supposing that he did? So what....There are discussions all over the place with every damn attorney around. It’s one huge round table discussion and everyone has an opinion. It’s what the courts are for...to settle these matters.

I saw that exchange last night and it was indeed odd and Kavanaugh was visibly thrown for a loop. I thought his response was credible. He basically said he’s discussed the case with other judges and that if the Senator could provide a name he could confirm or deny as he didn’t know everyone who worked at that law firm. She would not give out a name (in other words, did you discuss this case with ‘x’).

When she asked that question, she also made comments such as, be very specific and also said something to the effect of this is a very specific question. She kept pressing him on different subjects and it was odd I thought when she said things like you’re not going to answer this so we’ll move on.

I think the game plan there was to possibly force him to recuse himself if any Mueller investigation items ever went to the Supreme Court for a ruling (such as forcing the President to go under oath at a grand jury).

I really think Kavanaugh did not come off well and needs to answer the flipping question unless it is somehow privileged information.

After Sessions’ recusal on... well... everything, I cringe when I hear that word any more.

I think Kamala Harris came off really badly as a sleazebag demonicRAT trying to trap someone in a manufactured ‘process crime’. It should be obvious to anybody with a three-digit IQ that the demonicRATs’ anti-Trump strategy has ‘process crime’ as a major component.

I think Kavanaugh should call out all leading and presumptuous questions. Then he should mention that the “Ginsburg” rule precludes him from discussing matters which might come up in, or be a part of future cases. He can’t know what he might thing until he hears all arguments and evidence.

He's said he's discussed the case and asked her to be more specific and name a name. She wouldn't do that. Could she not have asked the question such as, did you discuss this with 'x'? If he said yes, she could have said, do you realize 'x' works for the 'y' law firm?

This is Washington D.C. and everyone's a lawyer and they do work for multiple law firms and are possibly switching between working for law firms all the time. How is he supposed to keep track of who works for what law firm? She could have been fishing you know?

I think what she was trying to get at is for him to say he gave an opinion to someone who worked for a law firm representing Trump. The opinion may have had to do with something like he didn't think the President could be subpoenaed in a grand jury investigation. If she could have got that, he would have had to recuse himself if that case ever (and it may possibly do so) come to the Supreme Court.

Yep. As soon as he is confirmed, a special counsel will be assigned to investigate every move Kavanaugh has made.

Kavanaugh already expressed that in his opening statement. He listed several other “rules” created in other SC nominee hearings as well.

How can he answer a nonspecific question with a specific answer? Why doesn’t she give a name if she wants a specific answer?

Grasping at straws. Harris needs to provide the name. Booker did something similar reading from a 16 year old email Kavanaugh had been cc’d on and couldn’t be given a copy to see the context to refresh his memory.

No doubt Harris was tipped off by someone about the conversation and is now trying to suck Kavanaugh into lying about it. It won’t work. Several Dems on the committee have already pressed Kavanaugh to commit to recuse himself from any future matter dealing with Trump that may come before the court.
