Ex-FISA court chief defends DOJ, FBI for handling of Carter Page surveillance applications

U.S. District Judge John Bates, who once led the U.S. Foreign Intelligence Surveillance Court, defended the Justice Department and embattled intelligence community for how it handled the application process to obtain warrants to spy on onetime Trump campaign aide Carter Page.

Bates, who was placed on the FISA court by Supreme Court Chief Justice Roberts and was its presiding judge from 2009 to 2013, said he has seen no evidence lending credibility to Republican concerns that officials misled the court in obtaining a 2016 FISA warrant and three renewals.

"I will note and note with some force that I have seen nothing that indicates that the court was misled, that the Department of Justice or the intelligence community made misrepresentations to the court," Bates told Lawfare podcast co-hosts David Kris and Nates Jones, the founders of the Culper Partners consulting firm. "And not only have I seen nothing that would indicate that, I have heard nothing that persuasively makes that case."

The Fbidoj’s own Policy is to not put unverified info in FISA applications.

The DoJ is a Dem Activist Org.

It’s really as simple as that.

I can make a persuasive case. Since Carter Page was the primary subject they must have had significant, substantial proof he did something wrong. Was he ever indicted of anything???

The FISA process is secret.

I have not seen any evidence to support the claim....

DUH!

He added. I have never been to Japan. And since I have not seen evidence that it exists, I must back the claim that is does not exist.

Bates said he supports greater transparency for the FISA process, including the release of FISC opinions and orders as long as proper considerations are made to protect such things as sources and methods, but warned against the release of application materials.

IOW, we are justified in framing, investigating, bankrupting, and incarcerating anyone and we don't have to disclose how we applied for the warrants, because muh national security.

And he's wrong.

Even worse: He could be RIGHT.

I have long suspected that Carter Page was a Democrat/RINO mole planted in the Trump campaign for the sole purpose of establishing a justification for the FISA surveillance.

Isn't anyone here wondering why he seems to be the only named person in all this chicanery who has NOT been charged with any criminal offenses?

For a while the story was that the poor FISA judges didn’t know that the evil DOJ misled the court. Now this ex-judge, and other ex-doj toadies, are saying the judges were aware that the dossier was a political document but they were justified in issuing warrants anyway. After all, the FISA judges were appointed by Republicans!

It's a funny thing about FEC records because they turn up things you'd probably not always like to be seen. Judge Bates is married to Carol Rhees and lives in Bethesda. Search for John Bates from Maryland and you come up with nothing. Search for Carol Rhees instead and as I said, winner winner chicken dinner.

Judge Bates is anything but impartial.

Judge Bates has seen nothing to indicate that the corrupt FBI-DOJ misled the FISA Court by fraudulent misrepresentation, but that merely states what is already known by all of us.
The corrupt FBI-DOJ misled the FISA Court by fraudulent CONCEALMENT of the critically relevant fact that the Dossier supporting their Surveillance Warrant request was completely unverified RUMORS paid for by Trump’s opponents, the Clinton campaign!
