Judge halts Mississippi abortion law

A federal judge on Friday blocked a Mississippi law that banned abortions once a fetus's heartbeat is detected, as early as six weeks into pregnancy. Judge Carlton Reeves, an Obama appointee, wrote that the law "threatens immediate harm to women’s rights, especially considering most women do not seek abortion services until after 6 weeks."

Sequoyah101: What happened to the 10th amendment? States rights?

Shadow44: Dead, along with the 9th Amendment.

9th Amendment: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage other [rights] retained by the people.”

I'm going to guess that the 9th Amendment is a double edged sword on the abortion issue.

I don't know the legal history of the “Right to Privacy.”

But, the alleged Right to Privacy is one cornerstone of the “right” to have an abortion, and it is definitely not one of the “enumerated rights” in the Constitution.

Jail, hard prison time, for judges who legislate or enforce judicial legislation. Judges may only make rulings on existing law. All law must conform to USConstitution thru the glass of the Declaration of Independence.

If their is no such (lawful) remedy for the plaintiff then the only ruling possible is: no jurisdiction.

Another Federal Judge making an ideological political decision from the bench then attempting to find a legal argument to back his ruling. In this case (as in many others), the legal argument doesn't make sense.

Good question but I wouldn’t expect the judge’s ruling to survive en banc review, the 5th circuit is solid Republican.

IIRC both Bork and Scalia agreed that the 9th and 10th Amendments play no part in judicial consideration these days, and never would again (this did not reflect their own preferences, merely their assessment of the current state of the judiciary)
