The problem for Comey is that this defense will not be available to him.

In his case, the question is not whether he acted in enforcing a warrant issued by the court. Comey’s problem is that he was instrumental in fabrication of facts presented to the court.

So that leaves two questions to be answered.

#1. Was Comey instrumental to the extent that he can be prosecuted?

#2. Are the penalties severe enough that he can be imprisoned, or are the penalties no more than a slap on the rist and being branded “bad boy”?

Maybe for perjury or false statements in relation to that, but not for the abuse on its face. Once a judge signs off on the application, the abuser obtains a legal defense. 50 USC 1809(b).

I don't know for sure if the civil claims of 50 USC 1810 persist, but I think they do even if the surevallance as authorized by a court of competent jurisdiction.

My gut tells me the courts would not allow an aggreived person to prevail, and that this section of law is toothless pap meant to fool the public into a sense that the government is honest and practices restraint.

Nowhere does it say Will Not Prosecute.

It's in the Introduction. Bottom of Page 2: "Upon completing our investigation, pursuant to Section 4(d) of the Inspector General Act of 1978, the OIG provided a copy of its factual findings to the Department for a prosecutorial decision regarding Comey's conduct. See 5 U.S.C.A. App. 3 § 4(d) (2016). After reviewing the matter, the Department declined prosecution."

Here’s what I don’t think you’re considering (or AG Barr, for that matter). Every DAY... EVERY SINGLE DAY that millions of Americans see NO justice being handed out for outright sedition and criminal cover-ups of it in this country they are either getting more and more angry with, or more and more disillusioned with our system of “justice” - neither of which is at ALL healthy for a functioning society.

It’s just a day dream to think Comey is going to be prosecuted for something the FISA court hasn’t even sanctioned him for. We’re being lied to and gaslit to keep Trump voter turnout up for 2020. If GOP base morale collapses due to the coup the Dems will win in a landslide.

The Durham report will prove beyond any shadow of doubt that Comey violated the law by signing those three FISA warrants illegally

The part you are wrong about is, Barr will again refuse to prosecute.

And he’s already telegraphing us as to why he won’t prosecute.

Really, this shouldn’t be difficult. I’m surprised to see so many people still in denial about the bipartisan nature of the coup.
