Ginsburg health scare raises prospect of election year Supreme Court battle

The recent hospitalization of Justice Ruth Bader Ginsburg following a year of health scares has raised the prospect of a Supreme Court vacancy in an election year and a partisan battle royal that would likely surpass the impeachment fight.

Liberal activists are already calling on President Trump to keep any possible Supreme Court vacancy open until after the 2020 election, but Senate Majority Leader Mitch McConnell (R-Ky.) has indicated he would fill a court vacancy next year, even though he blocked former President Obama’s nominee for most of 2016 after the death of Justice Antonin Scalia.

“If we had a Supreme Court vacancy this year that Trump attempted to fill, it would be in the middle of an election year but not just any election year. It’s going to be a year in which Trump is likely to have been defending claims against abuse of power and obstruction of justice in an impeachment trial,” said Marge Baker, executive vice president of People for the American Way, a progressive advocacy group.

Liberal activists think they would have a shot at derailing a potential Trump nominee next year, as Senate Republicans will have to defend 22 seats, including seats that Democrats have a good shot of picking up, particularly in Arizona, Colorado, Maine and North Carolina.

After watching vulnerable Democratic incumbents such as former Sens. Claire McCaskill (D-Mo.) and Joe Donnelly (D-Ind.) lose in 2018 — losses they both attributed to the messy partisan fight over Kavanaugh — vulnerable GOP senators may be reluctant to support a controversial Trump pick.

Controversial to who? The liberals? The liberals who create scenarios and trumped up charges of sexual assault? The liberals who lead us to believe, that a decades long career in the law meant nothing, and that the only thing that mattered was what happened when two teenagers rolled around on a bed for about 30 seconds 36 years previously? Trumped up controversies will dissuade Republicans from supporting a judicial nominee????

This is what the impeachment inquisition is all about. If Trump is able to swing the Supreme Court over to 5 solid constitutionalists, it will fundamentally change the US. Unborn babies may be declared to be persons with rights, many gun control laws will be turned over, and many other decisions.

I hit “post” too soon. Need to add, even if the alleged rolling around on the bed at age 17 happened as described by the woman with two front doors, that was the only subject that mattered in the Kavanaugh confirmation, to the liberals.

I don’t think many Republicans will be persuaded by such criteria.

They had better grow some backbone pronto. We will not tolerate weaklings and Romneys (I guess I can use it as a noun). There are only so many publishers willing to take instant remainder memoirs of losers who beg to be on leftist TV panels and say "I hated Trump" and "the whole White House was in chaos because of him."

Even the low IQ CNN viewers get bored and say "what else can you show me?"

I hate to say it because he is one of my favorite justices but seeing how he's a 71-year old black men (and black men aren't known for their longevity) I think it might be time for Justice Thomas to consider his retirement.

There's a good chance the person elected in 2020 will pick his replacement.

As much as liberals love RBG, many are still angry with her for not stepping down in 2014 when Obama and a Democrat Senate could've picked her replacement.

I don't want to see a repeat of this mistake.

If Ginsburg codes dead before November, Trump would be wise to defer nomination until after the poll. He likely has a single page in a old folder that will handle this contingency better than anything I got.

Today I was in a CVS to pick up a prescription for my wife. While I was there, I heard a medical news report on pancreatic cancer. I learned the two-year survival rate is about 7 percent.

I suspect Joan Ruth Ginsburg’s tenure on the SCOTUS is rapidly coming to an end.

Bogus charges and a bogus trial, all set up for political purposes--nothing else! "Guilt by accusation" carries no weight.

If things happened as you describe, then the Supreme Court would be a major election issue, for both parties. It may be huge anyway, because the Justices are aging. Clarence Thomas as noted on another post, is 71. Sonya Sotomayor is 60+ but has had health problems. Breyer is pushing 80, I believe. And we know about Ginsburg. So potentially these three liberal justices could be replaced by the president elected in 2020.

If there were a USSC opening, I feel confidant the Senate will confirm quickly even in an election year. McConnell and the Senate know how important this is. Pres. Trump and the Senate have turned 3 Appellate Court Districts Constitutional. The 11th Appellate District is the recent third.

If the President gets nothing else done and is voted out, these appointees have changed the course of the next 10 years or more. Now on to the most over-turned and liberal Appeals District - the 9th. Hope there are some openings in the next year.
