ENERGY Court orders Dakota crude pipeline shutdown, in win for Native American tribes in long-running saga

A federal court ruled Monday that the Dakota Access Pipeline must shut down within 30 days, by Aug. 5, according to a copy of the brief obtained by USA Today.

The U.S. District Court for the District of Columbia scrapped a key permit from the Army Corps of Engineers, and ordered the pipeline to end its three-year run of delivering oil out of North Dakota’s Bakken shale basin to its endpoint in Illinois. The decision marked the end of a yearslong legal battle over the Energy Transfer Partners-owned pipeline’s environmental damage to the Missouri River.

President Donald Trump granted the permit in 2017 over the objections of the Standing Rock Sioux Tribe and environmental activists, arguing oil spills could contaminate their water source and put their culture at risk.

The court ruled the pipeline be shut down pending a full environmental review ordered previously.

“The Corps had failed to produce an Environmental Impact Statement despite conditions that triggered such a requirement,” the court ruling said. “Although mindful of the disruption such a shutdown will cause, the Court now concludes that the answer is yes.”

“Given the seriousness of the Corps’ NEPA error, the impossibility of a simple fix, the fact that Dakota Access did assume much of its economic risk knowingly, and the potential harm each day the pipeline operates, the Court is forced to conclude that the flow of oil must cease,” the ruling said.

Energy Transfer Partners did not immediately respond to CNBC’s request for comment.

A ruling by the Foreign Intelligence Surveillance Court on Wednesday mistakenly said Fusion GPS, the opposition research firm which hired British ex-spy Christopher Steele in 2016, was looking for dirt on former Secretary of State Hillary Clinton rather than on then-candidate Donald Trump.

The court fixed the glaring error only after the Washington Examiner brought it to its attention.

Judge James Boasberg, the court’s presiding judge, cited the Foreign Intelligence Surveillance Act applications against former Trump campaign associate Carter Page in a Wednesday opinion and, in the midst of pointing out the multitude of flaws, omissions, and factual errors in the electronic surveillance filings uncovered by the Justice Department’s watchdog, he made a mistake himself.

The same thing has been happening in Canada. Government and judges complicit with the Enviro-kooks in destroying the energy sector. The Province of Alberta was the cash cow of the Canadian economy and is now on life support, as investment flees for more friendly pastures.

They need to get an emergency stay of this absurd order pending appeal.

Here’s the real story as I heard it (and the media won’t tell you) I am sorry I don’t remember original sources, but liberals won’t believe it unless they find it for themselves any way (and even then...)

The oil companies used to transport oil through the Indian lands over the road, in oil trucks.

They paid the Indians PER BARREL, for ‘wear and tear’ on their roads and right of way.. etc. This was not an insignificant amount of money.

The oil companies figured they could transport a lot more oil through a pipeline, much cheaper.

They wanted to negotiate a deal to build the pipeline thought the Indian territory.

The Indians wanted the SAME amount of money, PER BARREL, which would have been a huge increase in cost to the oil companies, even thought they were not traveling over the road anymore.

So, the oil companies moved the proposed pipeline off of the reservation.

The Indians STILL DEMANDED PAYMENT per barrel of oil, even though the oil would not even be going through their reservation anymore.

The oil companies told them to F-off.

The Indians went to the odumbass administration and said the oil companies were putting a pipeline over their Indian burial grounds. Even though there were already existing pipelines along essentially the same route.

Odumbo agreed and stopped them.

The Indians have what amounts to a sovereign nation, within our borders. But they have incredibly stupid financial advisors.

In our area, the Tribe has several casinos, which have a casino gambling monopoly for hundreds of miles around, and is is constant dispute with the state over $tens of millions of dollars.

Yet if you drive through the reservation, its all broken-down mobile homes and high mileage cars parked on the lawn. It seems like poverty everywhere and much of the population are on welfare, supported by Fed.gov and the state.

The tribal elders IMHO are no different than mafia.

So this rat shuts down a pipeline that has been running for THREE YEARS pending an environmental impact report on the it being constructed. This idiotic ruling should be tossed by end of day but won’t be.

My thoughts as well. It’s been operating for three years and they can’t find a actual environmental impact it had, like the tribes have claimed it would, but the man to be shut down for a report.

Yeah it’s the same way here.

They should be opening factories and businesses all over- but all you see are gas stations, cigarette stores, and casinos.

And where does all that money go? Are there some rich Indians hiding somewhere?

Wandering back out into energy scarcity and foreign dependence for oil supply. This is something that should be put on a stay until appeal is heard.

The environmental damage that is supposed to be happening falls to insignificance compared to the environmental damage being done to cities all over the United States right now.
