It is too bad the author of the article did not properly read the EO. It does not read that “No COVID ordinance may forbid or impede any business from operating.” Nor does it read that “No COVID Fines or Penalties may be applied toward any individual or business operating in the State of Florida.”

The EO does 3 things. It prohibits local governments from preventing any INDIVIDUAL from operating a business or working.

It stops local governments from having an anti-covid measure mandating that restaurants and such operate at less than 50% capacity. It also orders that a local government show the economic impact and public health reasons should they mandate such establishments operate at less than 100% capacity as part of their anti-covid measures.

It then removes all fines and penalties being levied against INDIVIDUALS for violations of any anti-covid measures by local governments.

It is important to note the EO deals only with the anti covid measures and associated fines local governments mandate regarding an individual. It also deal only with capacity limits set on food service establishments.

The local government may still have anti-covid measures and penalties for same with the exceptions outlined above. For example a movie theatre could still be fined for going over an occupancy limit set by local anti-covid ordinance. A bar (not owned by an individual) could be shutdown if they flouted a local mask ordinance. A restaurant could still be limited to 75% capacity provided the local government could “quantify” the economic impact and explain how it would protect public health.

The one thing that is not clear to me is the EO in regards to local governments limiting food service establishments to less than 100% capacity. As a condition of doing this the local government is required to “quantify the economic impact of EACH limitation or requirement...and explain why EACH limitation or requirement is necessary for public health. Since the only anti-covid measure outlined in the EO for restaurants is the occupancy limit I don’t know what requirements it refers to. It might mean that if local mandates require that in order to operate at full capacity a restaurant must arrange seating so that a distance of 6ft can be maintained between tables that both the limit itself and any measures associated with that limit be justified per the EO.

BUT! A local business - for example, a Florida Power and Light power plant - could require contractors at its facility to follow any rules of any kind that FPL puts in place, right?

Florida Pirates and Looters could require that contractors adhere to FPL’s anti covid measures provided those measures did not violate other laws.

The Florida Pirates and Looters is just a standard joke about them. Personally I’ve not had problems with them. Fingers crossed. And I do know they are way better than the local city owned utility.

Mea Culpa. I must rescind my previous explanation. I completely missed (blame brain farts) two very important points as follows,

1. That the EO eliminated any and all restrictions set on businesses and individuals by previous EOs. Which pretty much puts Florida back to business as usual.

2. That section 2 of the EO specifically addresses Emergency anti-covid Ordinances promulgated by local authorities. It is these emergency ordinances that cannot prohibit individuals from working or operating a business. Such ordinances could still place restrictions on certain occupancies as I outlined in my previous post.

Regarding Section 3 of the EO, my comments on that do not change.

I am hitting myself because “go by the written” is one of my favorite mantras. To this I am adding “read all the cross references.” My apologies for any confusion.

This is what DeSantis’ EO does.

It lifts any and all state ordered limits on the capacity of gyms, fitness centers, retail establishments, libraries, museums, bars, food service establishments, and assembly (entertainment) occupancies.

It eliminates the requirements for social distancing measures at bars and restaurants as well as any partitioning needed to maintain same.

It eliminates restrictions on the on premise sale of alcoholic beverages.

It eliminates the requirement that restaurant employees be screened for Covid symptoms.

It lifts restrictions on health care services/medical procedures.

It lifts restrictions on vacation rentals.

It lifts restrictions on people traveling to and from Florida.

It lifts restrictions on the number of people who may congregate.

It allows Dade, Broward, and Palm Beach counties to enter Phase 2 of the reopening plan.

It specifies restrictions on working or operating a business may not be placed on individuals by local emergency ordinances.

It specifies which restrictions may be placed on restaurants by local emergency ordinances.

It eliminates fines on individuals for any Covid 19 violations.

It does not lift other provisions of local emergency Covid 19 ordinances.

Churches were closed down for many months. For the first time in my life I felt a NEED to go to church. Our church COULD have opened months ago, but only reopened 3 weeks ago. I have no idea why it was closed for so long. Other churches were open. So we went back Sunday and I watched to see if ppl were dropping dead. Nope. Everyone is fine. And almost zero masks.

I went to Lowes Hardware store in Leander Texas and the cashier told me you do not HAVE to wear a mask there, but employees do. So I shopped there without a mask and no one said a word. There were HUNDREDS of ppl there, no social distancing, and I was the only BRAVE person there without a mask. I will let you know if I catch Covid...

I suspect you will be fine. Each passing day reinforces my belief since February this is much overhyped and not nearly as deadly as reported.

Yep been seeing those commercials on TV.

We went to Key West the week of July 4th. The place was dead, only a few Restaurants were open. All Bar bars were closed. Mask’s were required to enter, but not if eating/drinking.

Overall it sucked (never thought I would say that). They are open now bars and all so we will head back down again when things get fully open (NO MASKS).

Mandates expire in parts of Tennessee tomorrow...since Governor Lee doesn’t have any balls; I expect him to extend the madness by EO. Health officials (most obese Karens) are begging him to keep the masks in place. WHO elected these ‘health’ officials in the first place?

That is what happened where our daughter lives in Weatherford Texas. No one was really requiring mask, there was no local mandate... Only one business was firmly requiring masks. Their business dropped off substantially. They no longer require masks!

“Could care less” is simply a colloquialism. Perhaps that Freeper, eyedigress, simply acclimates to the local vernacular. It is almost like dialects, so many colloquialisms and idioms. Our daughter, a brilliant HydroGeologist, dropped her minor - Spanish - because she didn’t have time to memorize all the idioms in Spanish. I have noticed while watching Italian, German, and Spanish movies, they don’t translate word for word, due to idioms and local vernacular.
