Galveston man roped by officers during 2019 arrest sues city of $1 million

A man who was arrested last year and led by mounted police officers down the street on a rope is suing the city for $1 million.

Donald Neely was arrested for trespassing in Aug. 2019. The officers on horseback tied a rope to Neely as he was handcuffed and had him walk several blocks as they rode next to him.

In a lawsuit filed, Neely says the incident caused him to suffer "embarrassment, humiliation and fear."

Videos and photos of the arrest quickly gained attention on social media at the time.

A spokesman said the city does not comment on pending litigation.

Galveston Police Chief Vernon Hale addressed the public after the arrest.

"We have stopped the practice immediately and we will be looking for more appropriate methods," he told a crowd in August.

If caught red-handed, I think it’s perfectly appropriate for a criminal to suffer a little humiliation (and a very mild humiliation it was). It’s not as though the villagers didn’t already know what he’d done.

I can see where the lawmen made their mistake. What they SHOULD have done is drag him hogtied down the street at full gallop. Three times back and forth. Or until all that was left was a long line of blood and grease.

So tired of these POS criminals hiding behind the law that they flout.

I just looked up the lawsuit. He is being represented by Julie Ketterman, who is a child support lawyer. After reading the complaint, it’s clear she has no idea what she is doing. She pled all state law claims, which should be promptly dismissed because there is no waiver of sovereign immunity for these claims under the Texas Tort Claims Act.

If there was any case here, it would have to be a federal civil rights claim under section 1983.

Punishment should be like 300 years ago. The perp should be placed in the public stocks, so everyone can see who he is, and the people can throw tomatoes at him.

Of course the race card gets tossed into the news story.

And, in response, Chief Vernon L. Hale, III, quickly bent over and spread his representative law enforcement cheeks:

"Although this is a trained technique and best practice in some scenarios [read: if the criminal were whitey], I believe our officers showed poor judgment in this instance [read: with a Black member of the community] and could have waited for a transport unit [read: with A/C and compliemntary snack service] at the location of the arrest."

In this day and age public officials need to navigate minefields. These cops rather innocently stepped on mine - they probably should have called for a squad car. So this harmless action will cost the taxpayers a few bucks (but nowhere near a million).
