Difficult to say, since I don't know the intricate nature here. FSU made it clear they not only refuse to hear an appeal with him, but they will fight this Christian student to the bitter end.

Sotomayor’s from NY so she might end up getting that circuit and Barrett if confirmed might get one of Sotomayor’s.
