If Elmer Manzano is a convicted felon, isn’t it illegal for him to even touch a firearm, let alone posses one in his safe?

That was my first thought, why did they give it back to him. It's a felony to give a gun to a convicted felon whether he owned it or not he is not legally able to possess it.

So I want to know WHO gave it to him. I know the police did not give it back, their not that stupid.

I understand that DAs have great leeway in deciding which cases to prosecute but they have no authority to order others to violate state and federal laws.

They didn’t give him a gun. He didn’t have a gun on him when he was arrested. He had ammo, which they returned to him because they had no legal basis not to.
