What happened is that the voters were given sharpies to fill out their ballot. The voting instructions clearly say not to use a sharpie as the ink will bleed through causing a “blotch”. When the machine sees this, it flags the ballot. The poll worker was to instruct the voter to press the button to override the “flag” and let the ballot count. Instead, the “button” canceled the ballot and vote did not count. This has been pointed out a few days ago (Sharpiegate) and looks like the lawsuit has finally arrived - they need people to sign affidavits to claim it happened.

When I’ve voted, I was always given a ballpoint pen with black ink to use.
