WASHINGTON—Investigators have made a preliminary determination that the police officer who shot and killed Ashli Babbitt during the U.S. Capitol riot shouldn’t be charged with any crimes in connection with her death, according to people familiar with the review.
Ms. Babbitt, who served for more than a dozen years in the Air Force and Air National Guard and became a passionate supporter of former President Donald Trump, died from being shot by a Capitol Police officer after rioters smashed through a door to the Speaker’s Lobby on Jan. 6. She had entered the building as part of a crowd aiming to disrupt the certification of President Biden’s victory in the 2020 presidential election.
The officer who shot her had been placed on leave soon after the riot while Ms. Babbitt’s death was being investigated, including on the question of whether it was a violation of her civil rights.
The Justice Department said in announcing the investigation that it was following routine procedure for whenever a police officer uses deadly force by having the Washington Metropolitan Police Department examine the shooting. The police investigators have made an initial determination that charges against the officer aren’t warranted, the people said, adding that Justice Department officials haven’t yet made a final determination on the matter. The U.S. attorney’s office in Washington is leading the broader investigation into the riot and prosecuting the more than 150 cases that have resulted to date.

- there was a totally defensible barricade between him and the protesters,
- there were at least three other armed officers on his side of that barricade who could have taken positions indicating clearly their intent to defend it,
- there were other armed officers on the other side of the barricade among the protesters NOT choosing to take immediate action,
- Ashli was unarmed,
- Ashli was in an indefensible posture, climbing carefully through an opening, and so had ZERO possibility of posing the least degree of threat, even to another unarmed person,
- had Ashli been permitted to make ingress, she would have been alone, and easily prevented from unlocking the door that was her objective,
- prevented from unlocking the door, she would be cut off from the others, and easily taken into custody peacefully.
That the Officer, instead, chose lethal force is utterly inexcusable Murder in the First Degree.

This is certainly a huge part of the picture. Folks here would be cheering if this had happened at the White House with Trump inside. Alternatively, the left would be screaming "murder".

He killed an umarmed woman who could have easily been contained. If that is not murder, I do not know what is. He better be charged or the government is questionable. There was no reason to shoot her. He shot when there was no reason. He must be held accountable. If he is not, the government is complicit in the woman’s murder.

If you didn't catch the sarcasm of Praetorian Guards vs Plebeians, your sarcasm detector is way out of calibration. That said, anyone smashing their way into the US Capitol Bldg, White House, or SCOTUS Bldg as part of a mob, can most certainly expect they may be shot by those defending the building and people inside.
Had antifa forced their way into the White House like this group and been shot, people would be cheering the shooter as a hero.
