Thank you for the clarification.

I get the reasoning, but this seems like such a high level
case, the normal channels should be bypassed for a quick
hearing.

It will take years to get to the court, and by then who
knows how much mischief will have been added.

I believe the case went to her. It was her call alone to hear he case or not. I knew last week how is would turn out

So, how it works is this:

It goes to the circuit justice. He can either decide to refer it to the full court (with a recommendation, but that’s behind the scenes stuff we don’t see) or handle it himself. If he handles it himself and says no, then yes, you can ask another justice. That justice has the same options. And it continues. So, yes, technically. the whole court can be asked. But that rarely happens because a justice is going to refer any matter that is debatable to the full court. Usually only the slam dunks are handled by individual justices. So most people get the hint. And those that don’t are going to be referred by the second justice to the whole court because obviously it isn’t going to stop until the hint is smacked over the head.

BTW, it’s extremely rare for the whole Court to go against an individual justice’s public action. (Not the same as that secretive recommendation.) We are talking a justice has had a stroke and is issuing crazy stuff rare.

It is- does this mean the SCOTUS won’t hear the case at all?? Or they will in due time but they won’t put an emergency halt to Monday’s deadline??

Not me, today I met with a fourth person whose elderly father just died. He was 74, got the jab, then a week later developed epilepsy, then heart problems then died of a stroke.All I know is in In my front yard , I personally know 4 people with adverse reactions to the jab, including death. The jabs are evil and a failure.

I have a fairly good understanding of the Circuit Court
process, but this is the Supreme Court.

The article was written to make it seem like the full
Supreme Court addressed this issue. It didn’t, and
that prompted me to address what the alternatives were
now.

Sotameyor is the district judge for a tri state area that covers emergencies in New York for the SCOTUS. According to what I’ve found her decision was made by herself and no other justice was in on the decision.

She also made no statement on her decision. Just no, and went into the night.

I believe the racist satomayor did the same thing with the New Haven’s firefighters case when she was on the federal court. It finally made its way to the SCOTUS when she was on the court (2013?).

They voted in favor of the New Haven FF and she lost.

A Freeper with law knowledge could fill in the blanks.

I agree totally, I was just making fun of the teachers union who demanded everyone get the vaccine and are now trying to get the court to keep THEM from getting it.

Oh, good grief. I’m talking about the Supreme Court here. “Circuit justice” means the Supreme Court justice assigned to that Circuit. And What I stated is exactly the process.

So tired of being “corrected” on this site by people that don’t read.

I really wish that people would research what the Article III Standing requirement actually is before making that tired remark.

I suspect it was a sarcastic comment borne of weariness over various courts’ abuse of the principle of standing, simply using it as an excuse to avoid getting involved in politically touchy issues. I understand the sentiment, though standing was not the issue here.

Constantly claiming lack of standing, though, has destroyed the credibility of the court system. It appears that they simply don’t want to do anything, and hide behind “standing” to avoid involvement. It’s gotten to the point where it seems that citizens no longer have any effective access to the “justice system”, and that causes well-deserved general distrust in the courts.
