If someone killed that pregnant woman, and the not-yet-a-human died as a result, the killer could be charged with two murders.

The Constitution limits government, not man. The issue of abortion is the protection of life.
Man was already born with rights from God, those rights are not limited or needed to be written down on paper. You were born with the right to hunt, make alcohol, drink alcohol, fish, feed your family, movement, etc. Things like that aren't needed to be written down on paper.
