Trump: Power to Classify, Declassify 'Lies Solely With the President'

A new statement from Donald Trump's team amid the raid on his Mar-a-Lago residence stresses that the president had "the power to classify and declassify documents."

Just the News founder John Solomon read the declaration Friday night while appearing on Fox News' "Hannity."

"As we can all relate to, everyone ends up having to bring home their work from time to time. American presidents are no different," Solomon read. "President Trump, in order to prepare work for the next day, often took documents including classified documents to the residence.

"He had a standing order that documents removed from the Oval Office and taken to the residence were deemed to be declassified the moment he removed them," the statement continued. "The power to classify and declassify documents rests solely with the president of the United States."

Trump's statement also challenged the idea that "some paper-pushing bureaucrat" needed to approve the former president's document declassification, calling the proposal "absurd."

The new comments by Trump come amid his claims that former President Barack Obama kept over 30 million pages of documents, "much of them classified," Trump wrote in a short statement through the Save America PAC earlier on Friday.

No SCIF at Mar-a-Lago? Why wouldn't the ‘southern White House’ not have a scif built in it. Why not lock the $hit in there?

But, if the FBI did find questionable stuff in June, it was their duty to handle it right then and there if it was a national security concern. To let it sit around for months would also be criminal in their actions.

“To let it sit around for months would also be criminal in their actions.”

The FBI spied on Trump before and after his election. They falsified documents in an attempted coup (treason). They helped prevent Trump’s re-election by covering up the Hunter Biden laptop. This document thing is probably the least criminal thing they’ve done since 2016.

Trump should demand of the court that all the documents taken from his residence be returned.

The point of DOJ asking the Secrete Service at The Residence to put another lock on the door is........

They now have a SS agent or agents they can bring in for testimony that the lock originally on the door was not proper to secure classified information. They can put him/her/them on the witness stand and lead them to say that the lock they put on the door was much more secure than the original lock. That puts some doubt in jury mind that President Trump was not taking proper care of classified documents.

Not sure we will recognize ths country come 2025. especially if the Far-left retains control this Fall. It is only one vote shy in the Senate to pack the SCOTUS with Garland types. If Pelosi hold power as well..its the doomsday scenario. We will be a country ruled by shadows writing laws and executive orders for a demented puppet to sign off on ,mumble a prepared word or two, on and return to his underground cave.

One problem: President Trump’s authority ended when he left office. Biden could reclassify everything and then prosecute Trump for posession of classified material.

Nope. Biden could try to take possession of the formerly classified documents and THEN classify them.

The executive branch can't classify documents that are not their documents, nor can they classify their own documents that are in somebody else's possession without giving that person a formal briefing and requesting those documents back.

I am so glad for the sake national security that these classified documents are now in a safe place where nobody can just walk in, stuff them down their pant and walk out without a question asked.

“Washington, D.C., February 21, 2006 - The CIA and other federal agencies have secretly reclassified over 55,000 pages of records taken from the open shelves at the National Archives and Records Administration”

Trump may have declassified documents pertaining to Russia Collusion and took them home with any mass distribution occurring. Biden comes along and reclassifies the docs.

Just a theory. Not sure that even happened but it could explain what is going on here.

All irrelevant since Trump said that he declassified the docs.

Nevertheless, given the FISA fraud, 2 nonsense impeachments, and the blind eye given leftists, I consider any charge against Trump to be baseless and solely politically motivated.

Yes, this boy has cried wolf so many times even the densest Democrats are saying "enough already - sh!t or get off the pot." I hope Rush is able to see the irony of these TDSers fueling their own ridicule that keeps them enraged like a crack-addled hamster wearing out it's wheel.

Because someone published it?

Forgive me if I'm not catching your entire point. I'm drawing a distinction here that is part of the security vs. liberty trade-off.

If someone deliberately reveals information that he knows was classified by a duly delegated authority to protect the current safety of the Republic, fry him.

If someone refers publicly to information that might once have been classified, but is now a matter of public record--general knowledge--even if the party who originally revealed it was wrong to do so (and one hopes has been duly fried), you can't go after him for reading it or talking about it now. It's public knowledge. In that sense, he's not saying anything new. Morally speaking, the leak itself should be denounced, but the "leak event" is over.

To take an extreme case, if I today reveal the information that was written on the paper hidden in Major André's boot--long after the trial is over, the fort has been secured, and André sent to his reward--I have committed no crime against our Republic. But at the time leading up to his trial and for the period thereafter, when the fort was still in danger, the information was still classified and in fact known to very few people. The original act of conveying the information to André was indeed a crime, as was André's attempt to deliver the information to the British. But us talking about it now is fine, and in fact it's important for us to know about it and discuss it.

The document held in that room were copies of the documents to be released when the Durham Probe is finalized. The Duhram Investigation is the Bondo that Barr/DOJ came up with to thwart the release and continue the coverup. This is why the Durham investigation, the paint, will last for twenty years as long as he doesn’t look where he’s not permitted, behind him at the DOJ. Attempting to release the unclassified documents will result in a obstruction of justice charge. Lawfare is the order of the day. Hence the lock, we don’t want the “we don’t know who released the documents excuse”. They then changed their minds to regain control of the copies. The raid.
