The independent counsel statute was originally passed in the 1970s in the aftermath of Nixon’s resignation. It was allowed to expire in 1999 after Clinton’s impeachment. It was almost certainly unconstitutional, as Congress cannot impose “independent” law enforcement mandates in the DOJ that operate outside executive branch oversight.
Congress can, however — and should — operate their own oversight of the executive branch. Nobody on the GOP side has the balls to do that effectively because the ultimate leverage Congress has is to defund or disband the DOJ entirely.
