After reading the NY Post link, the man did more than hurl racial insults. He also spit on his neighbor, put feces on his neighbor’s lawn and shot cars with BB guns. I have no problem with him being sentenced but the 4 years sentence is too long - IMHO. What I’d really like to know is why he spent the last two and a half years locked up in jail? Was he in jail waiting for trial? If so, he should sue the AG who put him in prison for being denied a speedy trial.

Defendants can, and often do, wave their right to a speedy trial. Some, anticipating conviction and long prison sentences, and expecting to get credit for “time served”, would rather sit in a county jail pending trial, than in state prison. If this miscreant had prior prison time, he might have reason to make that choice.
