I’m not an attorney, so may not understand certain things.
But it occurs to me, that they are disqualifying Trump for an alleged criminal offense for which he has not been charged, or ever convicted, in any legal proceeding.
I’ve heard some commentators say they expect the US Supreme Court to overrule the Colorado Supreme Court, on that very basis.
And since John Roberts like to rule on strict narrow legal issues, the Court would likely overrule the Colorado Supreme Court, put Trump back on the ballot, but not rule on the issue of whether he was involved in an insurrection.
I am not an attorney either, but the fact is that I do not think that Confederate government officials nor Confederate officers were charged nor convicted of any crime either, but they were, for a period of time, barred from public office. But their participation in the Confederate government and military was up to no debate as was the fact that the Civil War was an act of rebellion against the U.S.
As an aside, Dingell’s use of the phrase “our democracy” is a hallmark of leftist language.

President Trump was the President. Did he declare an insurrection on January 6? He did ask the people to go home.
