Appeals court rules against Trump presidential immunity in 2020 election interference case

WASHINGTON — A federal appeals court on Tuesday rejected Donald Trump’s broad claim that he is immune from prosecution for alleged criminal acts he committed as president in trying to overturn the 2020 election in a chain of events that led to the Jan. 6 attack on the Capitol.

Trump will almost certainly appeal immediately to the Supreme Court in a bid to prevent the trial from going ahead as scheduled in March. The Supreme Court could make a quick decision on whether to hear the case and could fast-track any ruling.

The three-judge panel of the U.S. Circuit Court of Appeals for the District of Columbia ruled that there was no basis for Trump to assert that former presidents have blanket immunity from prosecution for any acts committed as president.

The case is one of four criminal prosecutions Trump faces even as he remains the presumptive front-runner for the Republican presidential nomination.

Is he supposed to appeal first to the en banc circuit before he appeals to scotus?

This case is about President Trump obstructing the electoral voting, iirc, WHILE he was still potus.

My memory is that the electoral count act and his duties as sitting potus really does immunize him.

The DC Court is staffed by lefy Dem appointed radical judges.

They run Kangaroo Courts.

SCOTUS will grant an interim injuction and let the voters decide , scheduling a hearing post November which will become moot.

To note, the decision was unanimous with three of the judges having been appointed by Trump.

Immunity isn’t at the core. At the core is whether the Jan 6 activity was an insurrection.

I remember Pat Buchanan’s line of when he wins he’d turn to the Clinton’s at the innaguration and tell them they have the right to remain silent. I think it was Tim Russert who ask him what he’d charge them with. After a stunned look Buchanan admitted it was nothing more than a red meat line.

Nixon was under threat of pending impeachment and Senate conviction when he resigned. The pardon effectively removed that threat.
