Trump's sweeping immunity claim rejected by US appeals court

WASHINGTON, Feb 6 (Reuters) - Donald Trump does not have immunity from charges he plotted to overturn his 2020 election defeat, a federal appeals court ruled on Tuesday, bringing the former U.S. president a step closer to an unprecedented criminal trial. A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit rejected Trump’s claim that he cannot be prosecuted because the allegations relate to his official responsibilities as president.

"We cannot accept that the office of the Presidency places its former occupants above the law for all time thereafter," the unanimous panel wrote. The court concluded that any executive immunity that may have shielded Trump from criminal charges while he served as president "no longer protects him against this prosecution." The ruling, which Trump vowed to appeal, rebuffs his attempt to avoid a trial on charges that he undermined American democracy and the transfer of power, even as he consolidates his position as the frontrunner for the Republican presidential nomination.

Trump will appeal this, but it's what I was taught the law is. Nixon accepted a pardon because he could be prosecuted for crimes committed in office. Now, I don't believe that Trump committed any crimes. Trump's mistake is that he failed to call forth the militia to address an obviously rigged and stolen elections. People are rotting in prison as a result of that decision, and an illegitimate POTUS occupies the White House and appoints judges, etc. (Or more correctly, there is a puppet in the WH, whom someone controls.) It's worth noting that decision came from two Biden judges and one G. H. W. Bushie.

Clinton got immunity for anything that happened while he was in office. And that was announced about 10 minutes before he left the Whitehouse the last time.

They could have given an opinion reading, in short, that POTUS is not above the law and may be prosecuted after leaving office, but there were no crimes committed here, and shut it down. If Trump were a Bush, that's what they would have done, but he's not. Now if Trump want's to appoint me to the D.C. Court of Appeals, I could write some blistering dissents for SCOTUS to consider. We didn't get a dissent on this. Trump can move for rehearing en banc, which could delay things, or file for review at SCOUTS by certiorari. He can even do both simultaneously.

Correct. He committed NO crimes and these malicious prosecutions are purely political. The idea of trying to remove him from a ballot over charges not even adjudicated is ridiculous.

He will win, and these people are going to deserve every bit of revenge the American people can bestow upon them. Fie on them!

Yes, it does, dbags, for what those former occupants did while they were in office, but not anything they may do after leaving office. You are conflating the two to twist the law into a pretzel so you can get Trump. If the law worked they way you've twisted it, every cop, soldier, whatever would be instantly prosecutable for anything they did while having immunity the moment they became a former cop, soldier, whatever.
