If mayorkas and bidens policies were in contrvention/defiance of US law, and congress has spoken on the question by impeaching (though not yet convicting) mayorkas...can’t the family sue him for wrongful death damages? Then everyone else harmed by illegals jump in on the correct lawfare

It’s almost entirely discretionary. Judges can grant parole. The Executive branch can choose how and where to deploy resources. The DHS/ICE can set policies that prosecutors and judges will likely follow. There is a law, but the law allows for a lot of discretion. Obama could separate families; Trump would get flack for not changing it. Trump changes it and gets no credit for that. Biden changes it all again completely and 90% of the news outlets cover the massive surge and only grudgingly report when someone is murdered.

Essentially, the federal government cannot be be sued unless the gov’t agrees to be sued. The first step is a claim against an administrative agency by its own rules,

A rep or senator making your individual case as a private bill in Congress is easier.
