If he rules anything other than disqualified due to a conflict, then the Georgia State Bar Rules of Professionalism and Ethics can be tossed in the trash.
I’m still leaning toward McAfee doing the right thing due to the appearance of conflict.

If I was the judge and wanted my ruling to be appeal proof, I would attempt to give the DA as much of the benefit of the doubt as possible and “force” the other side to more than win their case.
I wouldn’t immediately rule - I’d wait a week or two to “carefully consider” the evidence multiple times, etc., etc.
Will DA appeal? Yes. But if the judge conducts himself the way he’s doing (skeptical), imo his ruling to disqualify will pass any appeal effort.
