Biden Administration Appeals Texas Border Law To Supreme Court

The Biden administration asked the Supreme Court to weigh in on a controversial law in Texas that allows state and local law enforcement to arrest people they believe entered the country illegally—the latest move in a back and forth on the Texas law that President Joe Biden’s team thinks undermines federal immigration law.

In an emergency request filed to the Supreme Court Monday, the Department of Justice said Texas’ state Senate Bill 4—which was signed into law in December and initially set to go into effect on Tuesday—would “profoundly (alter) the status quo that has existed between the United States and the States in the context of immigration for almost 150 years.”

The law allows state and local law enforcement officers in Texas to arrest and jail anyone they suspect crossed the border illegally, which immigration advocates like the ACLU of Texas are concerned “fuels racial profiling and harassment.”

The law would also put the U.S.’s relationship with Mexico at risk, the filing said, saying that if Texas can “remove noncitizens to Mexico without its consent,” there would be “significant and immediate adverse effects” on the relationship with Mexico that is “critical to the federal government’s ability to effectively address immigration at the southwest border.”

The Biden administration argues in the filing that “the authority to admit and remove noncitizens is a core responsibility of the National Government,” not that of states, and that allowing Texas’ law to go into effect would conflict with past rulings from the court.

Well well. It seems as though we celebrated a bit too soon with with today's news that Texas can enforce its own law against illegal immigrants.

So the administration has gone from "there is no border crisis" to "the border is closed" to "we can't do anything without Congress" to "migration is driven by climate change" to "you can't pass a state law about illegal immigration".

So which one is it? Is the border secure or not? If it is why worry that Texas will be arresting illegals? If the administration was following the law wouldn't they just send them back home?

Not so great messaging in an election year.

You'd think someone with dementia would have thought up this campaign strategy.

So, the Texas Rangers will see some brownish fellow speaking Spanish and immediately arrest him.

Good Lord, have these people ever BEEN to Texas?

If Joe Biden can ignore the Supreme Court's decision on Student Load Repayment, Texas can ignore the Supreme Courts decision on the border.

Let them try and enforce their decision.

This is insane. The FEDERAL government asks SCOTUS to rule on a STATE enforcing federal law that the federal government chooses to ignore.

Talk about a banana republic.

I'm expecting it. The leftists can't have Texas bottling up their portion of the US border. So, I expect serious blackmail going on with the SCOTUS. The Biden administration cannot lose this argument.

My hope is that the Supreme Court thinks through the ramifications of entertaining what this criminal administration requests. America needs a rebirth of Justice.

Every non-baseball Texas Ranger I’ve run into is brown, has a Spanish accent has a Latino surname.
All the others are gingers.
I’ve run into more than my share of Rangers while in Texas.

There's going to be a distinction...Federal Law calls them asylum seekers...but they must go to a "station" and register etc etc.

To the state of Texas,...they are trespassers...and have no right to be in Texas.

The problem is...The Feds are not enforcing existing laws which is resulting in trespass into the Great State of Texas...and other states.

That’s relative to a particular case....involving a FEDERAL election. The court was specific that the State could control local elections.
