Federal appeals court rules Pennsylvania must only count mail ballots with dates, signatures

The U.S. Court of Appeals for the Third Circuit ruled Wednesday that Pennsylvania may enforce state law requiring envelopes for mail-in ballots to be dated and include the voter's signature.

In Pennsylvania State Conference of the NAACP v. Chapman, the plaintiff sued the then-acting secretary of the commonwealth in 2022 regarding Pennsylvania’s decision to void mail-in ballots that are either missing a date on the outer return envelopes or have an incorrect date.

Pennsylvania counties were ordered by a lower court following a Republican lawsuit in 2022 to reject undated or incorrectly dated mail-in ballots. The issue was then appealed to the U.S. Court of Appeals for the Third Circuit.

The NAACP argued that the mail-in ballots are valid – regardless of the incorrect or missing date – and should be counted.

In the November 2022 election, 10,000 mail-in ballots weren't accepted because they had incorrect or missing dates.

On Wednesday, a three-judge panel of the circuit court ruled that the state law be enforced.

What a novel concept, only ballots with a date and signature that are mailed in/received by the correct time can only be counted.

Georgia’s voters reform at from a couple of years ago (remember they cancelled the all-start game over it), actually lloks pretty good. All states should embrace it: Among other things, GA requires a unique number (DL or other) to verify ballots are legit. This alone makes wide-spread fraud near impossible. Remember, in close states or counties, people can come in from other states to vote. DL #’s prevent this sort of fraud too. Mail in ballots maybe can’t be stopped, but chain-of-custody measures like GA can and should be the GOP’s number 1 priority.

In 2020 the Supreme Court ruled that ballots received after 8 oclock on election day couldn’t be counted.

They commingled and counted them anyway.


And in Montana, the Supreme Court has struck down a series of election reform laws:

The state imposed the reforms in 2021, limiting voter registration by imposing a requirement that voters register by noon the day before an election, according to The Hill. The state also banned 17-year-olds from receiving and using an absentee ballot, even if they will be of voting age by the election itself.

Another declared student IDs unacceptable for in-person voting while yet another required the secretary of state to work to prevent the paid collection of absentee ballots.

True, but how pathetic is it when one has to be reminded to follow the rules that were already in place? The courts should fine and imprison those who are willfully breaking election laws. At least it might decrease the number of people willing to ignore the rules.

The RNC should have spent the past three years working to tighten election laws nationwide in order to reduce election fraud. The Democrats sent Marc Elias and his minions out into every state working to make sure drop-box and mail-in ballots stayed legal. All with very little push-back from the RNC. The Democrats have multiple of attorneys available in every large district on election night while the GOP has very few.

After 2020, the GOP should have had attorneys in every major city in Ga, Az, PA, MI, and a few other states for the 2022 elections. I believe they even promised they would. But, come time to act there were few lawyers on the ground to stop the shenanigans and we lost several major races due to fraud.

So eight months before the election, and after most major primaries have taken place, we finally get new RNC leadership. That gives them little time to make a difference in this November’s election. Courts will be hesitant to force changes in any election laws at this point in the cycle. Ronna McDaniel should have be forced out some time ago (years actually).

That is one point I disagreed with Trump on and was disappointed when he endorsed her during the RNC leadership elections. Of course, like many RINOs, she can lie to your face with the best of them and pretend she supports Trump before turning around and stabbing him in the back.
