You have to make the motion. If you don’t, you have nothing to appeal. This judge may want Trump’s case to go to trial, but there are at least a dozen ways to force delays.
Deposing the judge’s daughter is one way and the judge certainly doesn’t want that. Demanding much more time to review a couple million pages of discovery is another. What’s the rush? /sarcasm
