It is likely that all — or nearly all — of the justices agree that a former president who attempted to seize power and remain in office illegally can be prosecuted.

But if that had been the case for PDJT he ought to have been convicted in the impeachment trial. He wasn't!

Exactly....Im not sure any Justices think such a thing happened to be honest. They would need to stick to the facts. Trump words, actions certainly do not lend credence to the conspiracy. Just last week NG and Capitol police basically corroborated Trump claims of security being turned down because of “optics.” and video shows us all where the violence started.... with the police. Trump is constitutionally allowed to dispute an election , especially one that contained so many anomalies and alternate electors certainly weren’t invented by Trump... its part of the process.
