Sharp: House Democrats are Destroying the Judicial Branch, But No One Seems to Care

In the most blatant move of hatred of the United States Constitution to date, U.S. Representatives Adam Schiff (D-Calif.)Ilhan Omar (MN-05), Jamie Raskin (MD-08), Melanie Stansbury (NM-01), and Senator Richard Blumenthal (CT) have filed legislation which will create an Office of the Inspector General to ensure accountability of justices in the Supreme Court of the United States.

The U.S. Constitution establishes three separate but equal branches of government: the legislative branch (makes the law), the executive branch (enforces the law), and the judicial branch (interprets the law). This bold move by house Democrats basically erases the separation of powers in United States government.

Unsurprisingly, Conservatives have shown little resistance or push back to this measure as they are yet to realize that it is even going. Should they be successful, in 5 years’ time most Conservatives will likely believe that this has always existed.

The heat was turned on in 1965 with Lyndon's Great Society, Welfare State, Racial Equality efforts.

The pot began boiling in 2008 when the big eared bastard came on the scene.

Now in 2024 the pot is at full boil.

Unconstitutional.

Congress has oversight of the lower courts that they create, but the only accountability for the Supreme Court is impeachment.

Watch Democrats pass it and then SCOTUS overturn it.

And that will mean nothing.

The Deep State marches on, ignoring Supreme Court decisions, just like Student Loan Forgiveness, Illegals imported for the Donors' purposes, redistribution of taxpayers' earnings to buy votes, etc.

The "Justice Department" (and ALL Regulatory Agencies) just go on their merry way, making up Laws, selectively interpreting Laws, etc. to do whatever they please.

The military has been neutered, so there's no fear of having opposition in ANY branch of government.

Maybe not 12-0 (it should be 12-0, do not get me wrong) but the question is whether the Dems would abide by it. Based on their actions concerning the border and student loans, I highly doubt it. Of course it helps when you have deep state true believers in the media cheering you on.

There needs to be a reckoning. Arizona is the latest to try lawfare to shut down the election by indicting the alternate elector supporters. The folks who are orchestrating this need to pay a heavy legal price for these attempts at Lawfare. We must clean up the Legal system of this country. The judicial branch is 1/3 of our government and must be rehabilitated. The perpetrators must pay the consequences of their actions!

Not even Trump can stop this mess. Things are going to get a WHOLE LOT WORSE, before they ever get better, and I don’t think they will get better, the changes the Libs have made are here to stay.

In part with GWBush and finally with DJTrump the Left has begun to lose control of the jusiciary, and thereby control of its outcomes, so the Left wants to try “legislation” to fashion a means for re-establishing political control over the federal judges.

Three things that ARE in the Constitution that are relevant are:

  1. Article III Section 1: in such inferior Courts as the Congress may from time to time ordain and establish

  2. Article III Section 1: The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior...

  3. Article III Section 1: receive for their Services a Compensation which shall not be diminished during their Continuance in Office

Regarding #2, "good Behavior" is not defined (just as "natural born Citizen" is not defined). This doesn't mean that Congress has the authority to define it. That said, since #1 gives Congress the power to establish inferior courts, it is assumed that they can define "good Behavior" as it applies to those inferior courts when they are established. The Supreme Court would be exempt from this Congressional power.

Regarding #3, there was a case in history (I can't recall the details) where Congress tried to realign the lower courts to eliminate a district that became disfavored within Congress. The judges fought the elimination of their district arguing that doing so would violate the compensation clause since eliminating the office diminishes (eliminates) the compensation.

This implies that Congress can expand inferior courts, can realign inferior courts, but cannot reduce the size of the overall judicial hierarchy. To counter this, Congress can reduce the size of courts through attrition by legislating that incumbent judges can remain but will not be replaced.

Taken in total, I'm not sure what this proposed Inspector General over the Supreme Court or lower courts can do. It cannot penalize a Justice or judge monetarily, it cannot remove a Justice or judge, and it cannot begin impeachment proceedings against a Justice or judge. The only thing it can do is require disclosure documentation, but only as it regards inferior courts.
