Prosecutors: Docs in boxes seized from Mar-a-Lago were inadvertently jumbled

Special counsel Jack Smith’s team acknowledged Friday that some evidence in the prosecution of former President Donald Trump for hoarding classified documents at his Florida home may not be in the same sequence FBI agents found it when they swept into the Mar-a-Lago compound with a search warrant in August 2022.

The concession from prosecutors in a court filing Friday afternoon came after attorneys for one of Trump’s co-defendants asked for a delay in the case because the defense lawyers were having trouble determining precisely where particular documents had come from in the 33 boxes the FBI seized almost two years ago.

In their filing, prosecutors acknowledged the government had previously — and incorrectly — told U.S. District Judge Aileen Cannon that the boxes remained “in their original, intact form as seized,” other than a decision to replace classified documents with placeholder sheets. That depiction, the prosecutors conceded, is “inconsistent” with their current understanding that some of the documents are not now in the same order as they appear in digital scans of the records that were made in the fall of 2022 after Cannon ordered an unusual process to review whether the FBI may have seized legally privileged records.

They were no classified documents and he is not charged under the law governing classified documents. There were some documents Trump declassified… but no current ones.

But they keep pushing the lie.

Who prosecutes the prosecutors for mishandling the “classified” documents. Placeholders for Trumps graduation pictures show that the documents removed where the nuclear bomb codes when they were just his graduation pictures./s Small cards and notes cannot be original classified material.

Don’t care if it was inadvertent. Fact remains the evidence is tainted and is inadmissible.

Wondering the feds are giving up on suing Trump given they can clearly see it’s increasing Trumps polling.

I believe the charges are basically mishandling classified information. The others especially Brandon and Hillary blatantly did this, but were never charged. Charges do not mean Trump is guilty, I believe this is all lawfare against him. The point I was trying to make is that they have one set of standards for Trump and another for the RATS.

Since you're taking the Biden DOJs position, some detail would be appreciated. Also, how does what DJT did differ from that of Biden, Obama, Bush, etc.

The case should be ended but the Trump team needs more time to expose the prosecutorial misconduct and the longer this drags on the closer to the election it becomes.

Exposing the misconduct is timed better and regardless, Smith will appeal the dismissal - which the seemingly corrupt Federal court system will probably grant.

Plus - if Judge Cannon shuts this hot mess down, her court is out

Trump has filed a motion to disqualify Smith’s appointment for all cases.

The Supreme Court will probably remand the immunity case back to Chutkins Court to determine whether Trump has immunity as an official act . We know how that one will go.

That would be a good time for Cannon to rule that Jack Smith is illegally appointed, which he was

Well in most cases this would be grounds to question ALL the “evidence” and possibly toss the whole thing out of court. Sadly, in this case, probably not. Nothing is off the table in pursuit of keeping PDJT off the trail. Kinda surprised he’s been allowed to leave the state with such “serious” criminal charges pending. I really do NOT like these people.

She can’t dump it too soon, the best place to keep this case is in her courtroom. Otherwise it will end up in the appeals court and risk getting the status quo, which isn’t good.

The statement that documents got jumbled is shaky but might be allowed on its face. What jumps out is that prosecutors are having trouble identifying where some of the documents were found. That could mean that evidence collection was flawed, or worse, documents were placed in boxes sometime after the search. "Planted" would be the term.

Cannon should order a pause at least, and tell the DOJ to provide a list of documents they are having trouble with regarding where they were found. If the DOJ cannot certify where the documents were found, the obvious response from Trump's attorneys would be: "It's because they were never there!"

Translated:

Incompetent + lied to the judge about it = Mistrial.

It seems ‘all too convenient’ at this stage.

I would prefer dismissal with prejudice on the weight of the evidence, but we all know that’s not practical with Smith’s setup.

I think the judge should say all the Mar-a-Lago is inadmissible due to government incompetence. Supposedly the DOJ sent their best and brightest to gather the evidence, if they can’t keep it straight it is the DOJ’s fault. The government had their change and muffed it.

Then let the DOJ either continue this charade or have it dismissed with prejudice.
