Trump’s ‘hush money’ NYC trial live updates: Stormy Daniels describes alleged sex with ex-president

Porn star Stormy Daniels is on the stand at former President Donald Trump’s “hush money” trial in New York today — a pivotal moment in the case.

Daniels is describing their alleged sexual encounter, at times in so much detail that Judge Juan Merchan scolded the prosecution, saying the nitty gritty was “unnecessary.” *** “In fairness to the people, I think the witness was a little bit difficult to control the witness," Justice Merchan said***

Trump attorney Todd Blanche moved Tuesday for a mistrial, citing what he called Stormy Daniels' "prejudicial" and salacious testimony about an alleged sexual encounter with Trump.

Daniels mentioned some details about her alleged tryst with Trump — like that there was an "imbalance of power" between her and the real estate mogul — that could unfairly "inflame the jury," Blanche argued.

“It’s extremely prejudicial to insert safety concerns in a trial about business records," he told the court.

“The issue is she has testified today about consent, about danger – that’s not the point of this case. That’s not the point of her testimony," he added.

Blanche also accused Daniels of changing her story about the encounter over the years.

Judge Merchan declined to grant the mistrial, but said he agreed with Blanche "that there are some things that would have been better left unsaid."

In fairness to the prosecutors, though, he added, "I believe that the witness was very difficult to control."

Donald Trump appeared to write a note on a legal pad as the judge tossed his attorneys' move for a mistrial.

He then passed the legal pad in the direction of Todd Blanche, his attorney.

“I was surprised there were not more objections to this testimony," Justice Juan Merchan says, after Trump attorney Todd Blanche moved for a mistrial.

That was the whole point of the trial. Either this merchan is a complete idiot and should be disbarred because he is too stupid, or they are calculating that this will somehow disaffect Trump from his followers. He should start immediate lawsuits against this court and the state of new york.

Isn't this kind of irrelevant prejudicial “testimony” grounds for dismissal?

Potentially. However, this judge appears to have skin in the game so I would be shocked if he would ever rule in favor of the defendant.

I've done many,many criminal cases from homicide, to white collar crime, to RICO drug cases. In this particular case, I've read and reread the indictment and “supporting” Statement of Facts. I sincerely don't see a crime here. This is one of those crime on top of a crime cases. The prosecution failed to articulate what the other crime (other than the business record entries) is. As for the business records, the claim that legal expenses is criminal is tenuous at best. The entries refer to a NDA, a legal contract. It sort of sounds like a bookkeeper could have thought that the payments were legal expenses. Honestly, I can't figure out this legally and factually untenable case other than it being a political persecution.

You should have heard Turley. The judge complained the defense did not object enough. For the love of God, the defense objected that she should be even be able to testify. Her testimony is on the judge.

Not true. This so-called judge has tied their hands in multiple ways while allowing the prosecution to do any damned thing they want short of pulling a gun and shooting Trump. For example, since when is a defendant not allowed to know who is going to testify against him until the night before their appearance in court? Yet that is exactly what Merchan has allowed the prosecution to get away with. It is so blatantly unconstitutional that it should sicken the soul of every fair-minded American.

Sigh. Lawsuits are not magic. The judge and the DA are immune from civil liability for their actions. Trump’s doing what he should do in using it as a grandstand. We are truly screwed as a country if there isnt at least a hung jury. It may even be that Marchan, at the end of the day knowing this can’t possibly stand up on appeal, orders a directed verdict. Any favorable outcome should be trumpeted day and night. Civil litigation is not the way forward and will absolutely fail

She’s a porn star, and she’s looking for fame and money. Every ruler or politician probably has a sexual past that would not fit the Puritan morals this country used to demand in its leaders—but we are SO far past that day! JFK, LBJ, Clinton—theh all had sexual escapades...at this point I just care about who is the best to be the leader. It’s definitely NOT JB! And RFK,Jr is a Democrat & too liberal. So, I’ll take Trump, regardless of the sexual escapades. He’s not selling out this country or our allies. He’s not opening the birder and our money’s up to illegals. I’ll take Trump. She actually helped Trump today..she said that Trump NEVER offered her a dime and told her to go to the press if she wanted to..so that destroys the entire prosecution case, their theory is that Trump paid her to keep her mouth shut, but no its the opposite, he never offered her any money, told her to go the press if you want to..it means this entire scheme was orchestrated by Cohen and Cohen himself, Trump had nothing to do with it

Sounds like a brilliant trap by the Defense to me.

They objected to Stormy being there, most likely based on lack of relevance to the criminal charge.

The Judge said no, she can testify, thinking that the Defense would object if Stormy got into lurid details.

Instead, the Defense just sat there and let Stormy say anything she wanted to say.

The Judge did nothing. He just sat there like a buffoon.

What will he do now - instruct the Jury to disregard Stormy's testimony?

The trial is over.
