18 U.S. Code § 611 - Voting by aliens
https://www.law.cornell.edu/uscode/text/18/611 ^ | U.S. Code

Posted on 05/08/2024 6:20:33 AM PDT by ProgressingAmerica

(a) It shall be unlawful for any alien to vote in any election held solely or in part for the purpose of electing a candidate for the office of President, Vice President, Presidential elector, Member of the Senate, Member of the House of Representatives, Delegate from the District of Columbia, or Resident Commissioner, unless—

(1) the election is held partly for some other purpose;

(2) aliens are authorized to vote for such other purpose under a State constitution or statute or a local ordinance; and

(3) voting for such other purpose is conducted independently of voting for a candidate for such Federal offices, in such a manner that an alien has the opportunity to vote for such other purpose, but not an opportunity to vote for a candidate for any one or more of such Federal offices.

(b) Any person who violates this section shall be fined under this title, imprisoned not more than one year, or both.

(c) Subsection (a) does not apply to an alien if—

(1) each natural parent of the alien (or, in the case of an adopted alien, each adoptive parent of the alien) is or was a citizen (whether by birth or naturalization);

(2) the alien permanently resided in the United States prior to attaining the age of 16; and

(3) the alien reasonably believed at the time of voting in violation of such subsection that he or she was a citizen of the United States.

Catherine Engelbrecht is out there doing what she can to make sure people read this. I wanted to link to it directly.

Note the underlined, directly from U.S. code.

The point is, yes, illegals can vote by law.

“The point is, yes, illegals can vote by law”

only if “each natural parent of the alien ... is or was a citizen”

Also if:

“the alien reasonably believed at the time of voting in violation of such subsection that he or she was a citizen of the United States.”

I presented the actual U.S. code. It really says this.

Hold it.

This does not say aliens can vote. It says aliens CANNOT vote except under stringent conditions, including being the natural or adopted child of TWO citizen-parents, AND being a permanent US resident for at least two years prior to reaching voting age, AND having reason to believe they are a citizen. E.g., merely claiming you believe you are a citizen is not having, or demonstrating you have, reason to believe you are one. Those are a lot of conditions to be met, in addition to having the state legal framework in place allowing for such a vote in the first place.

I realize the commies will twist this, but the law explcitly forbids aliens from voting for federal office with a narrow exception, not a broad one. So, just like all the other laws broken by the uniparty state, it would not matter if these narrow exception conditions were excluded, they would still ignore the law anyway. Remember, they are thieves and cheats. They are gangsters and crooks. By definition they do not eaven read the law. They simply claim to be in possession of it at every turn and to be able to use it to shut down decent, principled, honest, law abiding American patriots.

But we love to argue amongst ourselves about the finer points of the law when they are completely bypassing it and are down the road wreaking havoc while we bicker.

“I presented the actual U.S. code. It really says this.”

You are right, it does.

But the bit I quoted is also from the US code.

Read comment 6. Each of the three conditions has to be satisfied. This is what lawyers call a conjunctive test.

“including being the natural or adopted child of TWO citizen-parents”

under what circumstance would a child of TWO citizen-parents NOT be a citizen?

What’s written is moot.

We are no longer a republic.

Until the republic is restored, the law is whatever Deep State says it is.

None of the recent newly arrived millions could reasonably think they were citizens, but the democrats in the battleground states would pretend that they themselves believe they are citizens.

Laws ain’t worth the paper they are written on or the bits on a hard drive they are stored on. We are in the end stages of any law being anything other than something to ignore or to be used as a weapon against a person, group, or philosophy, by the state’s bureaucrats.

Until we restore the republic.

Which will also restore the rule of law.

I looked it up, and by golly you’re right. People are making it sound like all the illegal has to do has *think* he’s allowed to vote. There are really three tests, and that’s only one of them. From the law (note the “and”):

(1) each natural parent of the alien (or, in the case of an adopted alien, each adoptive parent of the alien) is or was a citizen (whether by birth or naturalization);
(2) the alien permanently resided in the United States prior to attaining the age of 16; and
(3) the alien reasonably believed at the time of voting in violation of such subsection that he or she was a citizen of the United States.

Sorry, I don’t understand why you are asking me about my summarizing the law? I honestly do not understand your point.

Also, please note that all three conditions must obtain, not just one of them. The law uses the conjunction “and”, not “or” to link the three conditions. So, even if you mean to suggest one of the conditions is trivial, all three must obtain for the exception to pass muster.

What have I missed, please?

Correct.
ALL THREE conditions of subsection (c) must apply for Subsection (a) to be inapplicable.

And this only after the improper vote is determined (post count!).
And where are the teeth; is there no penalty?
