ACORN to sue O’Keefe, Giles, Breitbart; fired workers to file criminal complaint in MD today?

Former ACORN workers in the city are planning to file a civil complaint against the makers of the video, according to the website Investigative Voice.

City state's attorney Patricia Jessamy said on WBAL's Shari Elicker Show that she could not prosecute based on restrictions for evidence obtained illegally.

Maryland law requires two party consent to be recorded.

Former employees of the beleaguered community activist group ACORN are planning to file a criiminal complaint in Baltimore against the creators of the series of videos that have spurred outrage against the organization, knowledgable sources have told Investigative Voice.

The filing could come as soon as Friday afternoon, sources said.

The criminal complaint will allege that recordings of the group’s employees giving advice on how to evade taxes and house underage South American sex workers to journalists posing as a pimp and prostitute were obtained illegally.

The criminal complaint is expected to name both James O’Keefe, 25, and Hannah Giles, 20, along with the owner of the website Breitbart, which initially released the videos.

ACORN is also contemplating a civil suit seeking an injunction aginst O'Keefe and Giles to prevent them from distributing the videos, according to an an email.

Isn’t this the same law that they persecuted Linda Tripp for in the Clinton/Lewinski scandal? Does this law also apply to FBI wiretaps or programs such as “To Catch A Predator”? It sounds to me like ACORN, that has lots of Federal money in their coffers, is going to try to bankrupt this couple. They will need a legal defense fund...

The issue will be whether these people were taped without their knowledge. The reason won’t matter and discovery will never reach into ACORN’s background.

Their plan must be to ruin them with legal costs. ACORN still has use of Federal funds. I hope the suits get discharged with prejudice and this move opens them to RICO.

LOL!! Even if ACORN isn’t quite dumb enough to try suing (and who can be sure?), you can depend on the fired workers doing it, who figure they have nothing left to lose! More POPCORN!!

Wait! What? I thought policing agencies are the only ones who need to acquire evidence legally. You know, a search warrant, blah, blah, blah. If a private citizen produces evidence they are not held to the same standard. Can anyone clarify? Thanks.

IANAL, but IMO there is a very narrow, the narrowest possible window where the plaintiffs (ACORN et al) might prevail. No doubt some pile of attorneys will take their money. But I truly doubt there is a sustainable expectation of privacy in a walk-in storefront situation, and this was obviously not a priveleged consult; eg, not attorney-client. ACORN might claim that this expose has damaged their ability to perform their mission, but then, ACORN is a non-profit, correct? So how would one measure the damages.

Juicy. Bring on the lawsuits, I say.

The left is going to go after the whistleblowers. You can count on that. Need to stifle that dissent. Need to make an example for all those copycats out there who might try something like this.

So what’s the counter-argument to ACORN’s case? If you can’t record them without their consent then how will O’Keefe defend himself in court?
