Virginia Attorney General Ken Cuccinelli took Obamacare to court today in U.S. District Court in Richmond. Judge Henry Hudson, a Bush appointee and former U.S. Attorney in the high-profile Rocket Docket in the Eastern District of Virginia is a very solid judge. Many Virginia lawyers, including your truly and Doug Mataconis, practiced before him when he was a Circuit Court judge in Fairfax County. I agree with Doug that regardless of the outcome of the ruling itself, it will be very well thought out. To put it bluntly, Judge Hudson is no slouch.

I have a feeling that 0bama is going to begin hating the courts in much the same way that FDR did. Just imagine if this judge deep sixes the “deathcare” legislation, and the SCOTUS affirms on appeal. The libs will scream bloody murder. I hope those judges have a good security detail.

I know this judge. He will shut this down on the basis that it is a violation of the 10th amendment and there is nothing about free medical crap in the constitution. This law is history.

Excellent!
Let’s play their game and do it by fiat. Not really let’s do it at the ballot box and if that fails the 2nd Amendment takes affect. We, as individuals, must form a militia to protect our God given rights against a government of tyranny.
It’s in the Constitution. If we still have one.

The federal government has moved to dismiss the suit brought forth by Virginia Attorney General Ken Cuccinelli on the grounds that it has the authority to enforce the law under the Commerce Clause in the Constitution.
The federal government is playing fast and loose with the history of the ICC. Under the Articles of Confederation, states had erected protectionist barriers that interfered with the free flow of trade. The framers of the Constitution wrote the ICC as a solution to make a free-trade zone within the United States. It gave no power to Congress beyond this purpose.

I wonder how this legislation was constructed. Is it one of those bills where certain parts can be struck down, or is it legislation that can be tossed if only an aspect of it is deemed unconstitutional?
