Olives naturally come with pits ~ and pitting is known to be imperfect.

Unless they made some claim about "weighing each olive" or straining them into an olive paste, his claim will be quashed like a bug.

Congressman Dennis Kucinich, D-Ohio, claims he suffered permanent injuries after biting down on olive pit hidden in a sandwich he bought three years ago at a House of Representatives cafeteria. In return, the Ohio Democrat is suing the cafeteria for $150,000.

Years ago I broke a molar biting into a take out hamburger that had a piece of bone in it that I had bought from a Burger King. When I returned to the Burger King the same day with the rest of the hamburger and piece of bone, the manager told me that since it didn't happen in their restaurant, I could have broken it eating just about anything. At that point I realized I didn't have the money for a lawyer or to have the bone tested to show that it came from their hamburger meat and decided to pay for my own dental work. One other thing that I learned was that once you start biting down on something with that part of your jaw, it's almost impossible to stop when you hit something hard.
Normally I would say that Kucinich doesn't have a case, but if he can afford the best lawyer to represent him, he will probably win. I wonder if he saved the pit???
