Teran Laplante was charged with carrying a concealed weapon when someone complained to police that he saw him with a black handled sword in a sheath in his shorts. The Appellate Judge held that the decorative sword that the man had in his shorts didn’t fit the definition of a weapon in the applicable criminal code. The man was previously found not guilty of the crime, but the prosecutors appealed to this higher court. The Judge said that the prosecutors failed to prove the sword was designed to cause harm.

“The man was previously found not guilty of the crime, but the prosecutors appealed to this higher court.”

And this doesn’t fall under the category of “double jeopardy” how?
