Who is Judge Michael Malihi?

Immediately after hearing that Georgia Judge Michael Malihi ruled against the Plaintiffs in the case regarding Obama’s eligibility to be on the 2012 presidential ballot, and hearing that Malihi was a Muslim Iranian, I decided to find out all I could about him. Is his ancestry really Iranian? Is his faith really Muslim? And did either of these things, if true, play a role in his decision to side with Obama in the Georgia eligibility hearing?

I set out to find all the details I could. What I found was precious little.

Judge Michael MalihiJudge Malihi is the Deputy Chief Judge for the Georgia Office of State Administrative Hearings. He was appointed Judge in 1995. If you go to the official website for his office, what you don’t find may be more interesting than what you do find. On the OSAH website there is a page which lists bios for all the judges, including Malihi. I clicked on Malihi and all that was listed for him was this:

That’s it! If you click on the links for all the other judges listed, you will find a brief bio telling of where the particular judge was born, where they went to school, etc. But for Malihi? Nada! Zip! Niente! Bupkis! Nothing!

I decided to look at other websites for other state or federal judges to see if its common practice to have absolutely no information listed in their bios.

The Federal Judiciary Center has a massive list.

The directory includes the biographies of presidentially-appointed judges who have served since 1789 on the U.S. District Courts, the U.S. Courts of Appeals, the Supreme Court of the United States, the former U.S. Circuit Courts, and the federal judiciary’s courts of special jurisdiction.

I examined a sampling of about 50 judges listed on this site and they all had bios which contained at least when and where they were born, when they died if applicable, where they went to school, where they practiced – their career path.

At the official Supreme Court site, bios of all judges were listed.

I looked up judges in various states, in a variety of different roles and guess what? Out of the approximately 15 different sites I visited for different states, bios were present for all judges! I looked up Circuit Court judges, Appellate judges, Superior Court judges, and more. They ALL had bios listed.

Nothing on Judge Michael Malihi.

Isn’t that interesting? So I ran searches on several search engines on his name. Was I able to find out much more?

On Google, all I found was essentially what has already been posted on this blog, and others regarding his recent ruling in favor of Obama and his eligibility to be on the 2012 Presidential ballot in GA.

The law is what the law is. If you do not understand what the law is, then simply read the Ankeny v. Governor decision, the second part dealing with natural born citizenship. This case was found “persuasive” a few days ago in Georgia.

The case relies very heavily on the 1898 Wong Kim Ark US Supreme Court Case. it is your right as an American to disagree with the decision, but you are on shaky ground if you provide false and misleading legal advice to others.

The entire two citizen parent theory is Imaginary Law was invented by a guy named Leo Donofrio a few years ago. This is why Jerome Corsi did not mention the silly theory when he wrote Obama Nation in 2008.

Good conservative attorneys, like Mark Levin, use a lot stronger language about this, and I quote him:

“I want you to listen to me on my social sites. Marco Rubio was born in Miami, Florida. He is a natural born United States citizen. And if I get any more of this Birther crap up there. . .this is a warning, and I don’t care who you are, you’re going to be banned. Okay? This is a site I put up for rational people. Marco Rubio was born in Miami, Florida in 1940, excuse me, 1971. He’s 40. There’s no debate. So take that Birther crap somewhere else. Just a warning. . .got it? I’m not into all that crap. You can go somewhere else for that.”

Statute law cannot overturn the meaning of the Constitution, upon which all statute law rests. I've only recently begun seeing those whom we lovingly call 'after-birthers', refer to that case on FR.

I've been a part of the Birther conversations on Free Republic since Obama's run for office first sparked them. I have spent hundreds of hours following those conversations, and studying countless references elsewhere. I haven't read the case you refer to, but I must say that I'm surprised that few have mentioned it, until now.

Given that I haven't read up on that case, I won't argue the merits of it with you tonight. I will say, that in the last few days, I've seen some well-informed Freepers dismiss it, as regards this issue.

You're new here, so I don't know how much time you've spent immersed in this subject. What I can tell you, is that this subject has been discussed and debated here more than any single topic that I'm aware of. So much so, in fact, there's a section of Free Republic entirely devoted to it.

To come to the point, you're holding the minority view about the NBC clause, so you've got your work cut out for you. You've got a very long debate ahead.

Many years ago I noticed something I considered peculiar about naturalized Americans. They appreciated having been granted American citizenship so much more than natural born citizens did … because they know what the differences are. I’ll bet that’s why he granted the trial in the first place.

Judge Malihi would not be a sitting judge in an American court unless he is an American.

There is NO debate. All you have to do is read the cases. Like the decision that just got handed down in Georgia. And Ankeny is real good. Why debate what the law is, when the judges are coming right out and telling you what the law is, and backing up their decision with quotes from the applicable cases??? That is like debating who won the Super Bowl football thingy. There's no debate. The New York football people won and already had a parade and everything. Same here. The courts are already ruling on this stuff so what is there to debate???

I am not new here. I was a Common Sense Suspicious Birther until April of this year, and even worked with another freeper to produce the youtube video, "Show Me The BirthFAX."

But I have NEVER bought into this two citizen parent lunacy. It is simply NOT the law. I have my own Think Tank, and since last summer, most of my Internet Articles are ones debunking the two citizen parent stuff. (Prior to that it was mostly about discussing Obama's refusal to cough up his long form.)

This might be what’s required in the tough times we are facing.

We're already living in "interesting times". Simply accessing the data you speak of, as overtly as you suggest, could put someone at the top of a whole bunch of lists.

Your idea has great merit, but none of this is easy.

Of immigrants from the top-20 sending countries to the United States in the years 1994-2002, an average of over 90 percent were dual-citizen immigrants. Of the estimated 8-10 million illegal immigrants in the country in 2002, 85 percent were from dual-citizenship countries. Their children too, become dual citizens.

I spent some time in the last hour looking through your posting history. What stands out prominently to me, is that you're an arrogant and disrespectful person.

You spent nearly the whole of November 13th, 2011 arguing with two of this community's most long-tenured and well-respected members. What grabbed me, was your sniveling, dismissive tone. I've rarely seen a newbie be so insulting to regulars on this forum.

I'm actually surprised that you didn't get the boot for that behavior. The fact that you didn't, speaks volumes about the quality of character of the ladies you spent hours belittling. Either one of them could have pulled rank on you, and at least had your posts pulled, or had you put on probation.

As far as your arguments tonight, they're patently weak, and are the minority view about the constitutional meaning of NBC. I'd roll up my sleeves and debate the issue with you, but I've tired of doing that over and over again with you arrogant newcomers. We Freepers have been through this subject a million times. Maybe someone else wants to educate you, but with your juvenile attitude, I doubt it. Most are going to just tell you to get bent.

Yes, naturalized citizens can hold dual citizenship but a natural born American cannot. That is why only NBC’s can run for the Office of US President.

What are your thoughts on the two Documents of Certification submitted by Pelosi and Alice Travis Germond-Sec./DNC prior to the elections of 2008?
If there was no question as to Barry’s eligibility, why the two differing Certificates?

I have watched this or something like it before. It was cleverly put together to fool people who do not understand the issue. The attempts were to permit NATURALIZED citizens to run for the office. People like Arnold Schwarzeneggar. Neither Obama, not Rubio, nor Jinda are NATURALIZED. Therefore, the promoters of this foolishness are attempting to equate "natural born" with "two citizen parents" where there is no evidence such is included in the definition.

However, they slip up on several of the attempts. First, Nichols proposed changes where he does not say anything about two citizen parents. He just "got it wrong" is what the producers say to trap the unwary.

Then, there are two or three attempts wherein NATIVE BORN is equated with NATURAL BORN, which is pretty much the same thing a lot of the courts do. Again, no mention of a requirement for two citizen parents.

So, this video is like cotton candy. Looks big, but mostly air. Here is a video I produced with the help of my BFF Fabia Sheen, Esq., a lawyer. I hope you like it:

You are correct.

A Natural Born Citizen cannot. However, a person Born in the United States to one or more parents who are not citizens of the United States can be a dual citizen. It really depends on the sovereign claim of the parents' nations that govern this situation of dual citizenship.
