Mark Levin’s liberty amendment flip-flop on balancing the annual budget

Isn’t it interesting to recall that on November 18, 2011 Mark Levin said he was “happy the balanced budget amendment didn't pass the House because it was a fraud”, and now Mark Levin promotes a fraudulent balanced budget amendment with one of his “liberty amendments” which would make it constitutional for Congress to not balance the annual budget?

The two of sections of Mark’s fraudulent balanced budget amendment making it constitutional for Congress to not balance the annual budget are:


SECTION 6: Congress may provide for a one-year suspension of one or more of the preceding sections in this Article by a three-fifths vote of both Houses of Congress, provided the vote is conducted by roll call and sets forth the specific excess of outlays over receipts or outlays over 17.5 percent of the Nation’s gross domestic product.

SECTION 7: The limit on the debt of the United States held by the public shall not be increased unless three-fifths of both Houses of Congress shall provide for such an increase by roll call vote.


Now, let us take a look at the “fair share” balanced budget amendment which would actually balance the annual budget using an apportioned tax as our Founders intended!


The Fair Share Balanced Budget Amendment

Proposing a balanced budget amendment to the Constitution of the United States.


“SECTION 1. The Sixteenth Amendment is hereby repealed and Congress is henceforth forbidden to lay ``any`` tax or burden calculated from profits, gains, interest, salaries, wages, tips, inheritances or any other lawfully realized money


NOTE: these words would return us to our Constitution’s ORIGINAL TAX PLAN as our Founders intended it to operate! And, they would remove the existing chains of taxation which now oppresses America‘s free enterprise system and robs the wealth which America’s productive Citizens and business owners have created.

"SECTION 2. Congress ought not raise money by borrowing, but when the money arising from imposts duties and excise taxes are insufficient to meet the public exigencies, and Congress has raised money by borrowing during the course of a fiscal year, Congress shall then lay a direct tax among the States at the beginning of the next fiscal year for an amount sufficient to extinguish the preceding fiscal year's deficit, and apply the revenue so raised to extinguishing said deficit."


NOTE: Congress is to raise its primary revenue from imposts and duties, [taxes at our water’s edge], and may also lay miscellaneous internal excise taxes on specifically chosen articles of consumption. But if Congress borrows and spends more than is brought in from imposts, duties and miscellaneous excise taxes during the course of a fiscal year, then, and only then, is the apportioned tax to be laid to make up the deficiency.

"SECTION 3. When Congress is required to lay a direct tax in accordance with Section 1 of this Article, the Secretary of the United States Treasury shall, in a timely manner, calculate each State's apportioned share of the total sum being raised agreeably to the Census fixed in the said Constitution and then provide the various State Congressional Delegations with a bill notifying their State’s Executive and Legislature of its share of the total tax being collected, a final date by which said tax shall be paid into the United States Treasury, and interest penalties for failure to pay said tax"


NOTE: our founder’s fair share formula to extinguish a deficit may be summarized as follows:


States’ population

---------------------------- X SUM TO BE RAISED = STATE’S FAIR SHARE

Total U.S. Population


This formula, as intended by our founding fathers, is to insure that each State’s share of the tax is proportionately equal to its representation in Congress, i.e., representation with a proportional financial obligation, or, one man one vote and one vote one dollar!


"SECTION 4. Each State shall be free to assume and pay its quota of the direct tax into the United States Treasury by a final date set by Congress, but if any State shall refuse or neglect to pay its quota, then Congress shall send forth its officers to assess and levy such State's proportion against the real property within the State with interest thereon at the rate of ((?)) per cent per annum, and against the individual owners of the taxable property. Provision shall be made for a 15% discount for those States paying their share by ((?))of the fiscal year in which the tax is laid, and a 10% discount for States paying by the final date set by Congress, such discount being to defray the States' cost of collection."


NOTE: This section respects the Tenth Amendment and allows each state to raise its share in its own chosen way in a time period set by Congress, but also allows the federal government to enter a state and collect the tax if a State is delinquent in meeting its obligation.



"SECTION 5. This Amendment to the Constitution, if ratified by the required number of States, shall take effect no later than one year after the required number of States have approved it.

Well, how about you calling his show and object to his proposed amendment and then suggest in its place our Founder's intended method dealing with deficits?

Last time I heard a caller disagreeing with him he trout's out the insulting remark "Get off my phone you big dope."

Aside from that, why do you have such a problem with constructive criticism of his "liberty amendments"?

So, concerned Americans are not supposed to worry about the propaganda and worthless remedies put out by our "conservative" talk show hosts? Seems that they all gave thumbs up to Mark Levin's liberty amendments without pointing to their hidden dangers.

On June 20th, 2013, I mailed my last available copy to Senator Ted Cruz. Never heard back. Additionally, while Mark Levin was in the Reagan Administration, Ed and I hand delivered a copy to every House and Senate Office.

Perhaps someone here will “tweet” or “hashtag” or whatever this new way of communicating is called, a link to the following thread I started here a couple of years ago. It contains a good portion of documentation concerning our founder’s method to deal with deficits.

Thumbs up to Mark Levin on phony balanced budget amendment!

Do my work for me? I thought the object was for true patriots to work together to restore our constitutionally limited system of government.

I've already devoted over 35 years of my life and thousands of dollars in the effort to restore our system of government by researching and documenting the legislative intent of our Constitution as stated by those who framed and ratified our Constitution.

It is interesting to note how you make me the subject of the thread rather than discuss what I have posted concerning dealing with deficits as our founders intended.

That's nice. I started in the conservative movement as a kid passing out Goldwater for President materials in 1964 in deep Democrat-run Rhode Island 50 years ago. Head to head counter-marched the huge anti-Viet Nam war commie protests in DC in 1969, 1970 and 1971.

And by your telling of it you only got started in what -- like 1979? Where were you when Reagan was first nominated in 1968 and first ran (and almost beat Ford's nomination) in 1976?

There's folks on FR (not many) who predate my creds for sure, but to some of us you are a Johnny-having-come-much-later to the gathering than a good many others, taking on a guy who is actually doing, writing, publishing, and strategizing for victory.

If you think your research is so valuable, why don't you do like Levin has done (who actually worked for Reagan), write a book or two, and find someone credible to publish it.

So balancing the annual budget in a no nonsense way is useless? I think Mark Levin would disagree with you.

Aside from that, if our Founder's method to extinguish a deficit was in place, can you picture the outrage of the Governors and Legislatures of our “progressive” states like California, New Jersey, New York, Pennsylvania or Massachusetts if their Congressional Delegation returned home with a bill in hand to extinguish an annual deficit they helped to create while in Washington, and these Governors and Legislatures would have to transfer that money out of their own state treasury and into the United States Treasury?

The truth is, our founder’s tax plan is brilliant and creates a very real moment of accountability which would end the irresponsible spending of “neo-statists” [Mark Levin’s terminology] and encourage each State's Congressional Delegation to follow sound fiscal policies to avoid the apportioned tax.

So what happens if the states refuse to pay? A federal judge will make them.

Our founders plan was brilliant right up until the crooks take over, then it all becomes worthless. The founders also knew this.

Many of the founders didn’t think it would last more than a few generations before tyranny arose again. They were more or less right.

The States are not inanimate objects, they are made up of people. The people of each state elect their members to Congress. And when their Congressional Delegation returns home with a bill because Congress could not live on the revenue brought in from indirect taxes, imposts, duties and miscellaneous excise taxes on consumption, and they are hit with having to pay a bill from their own State’s Treasury, I think the Congressional Delegation will receive its just JUST REWARDS for their irresponsible and tyrannical spending.

Did you miss that part in the proposed amendment which explains what happens if a State refused to pay its apportioned share in a time period set by Congress? If a state does not pay its apportioned share of the direct tax, Congress may then enter the state and impose a direct tax upon real estate. And, the Act of July 14, 1798, c. 75, 1 Stat. 53 did in fact imposed a direct tax upon real estate and a capitation tax upon slaves. For the collection and enforcement of the tax upon real estate by our federal government CLICK HERE and scroll down to “how the collectors shall demand and enforce payment”.
