MA Supreme Court Ruling- No lifelong oversight of sex offenders!

Ma Supreme Court today ruled that lifelong parole & supervision of sex offenders (including class 2 & 3 offenders) is a violation of their rights and they revoked the requirement!

The rights of convicts now outweighs the safety of women & children in this state!

Insanity has run amok. I hope there is finally some pushback from the voters in these states. I will not hold my breath.

I actually agree with this ruling. The laws need to be changed. Once you’ve served your time, you’ve served your time. Sounds like we need to make the time longer. That will fix it.

Exactly. Revoke the possibility for parole for sex offenders and make their sentences long.

Were these people not released on conditions that they would be watched? Would they prefer life sentences?

My guess is these judges don’t live in neighborhoods saturated with sex offenders.

don’t sex offenders have a very high rate of recidivism, compared to other crimes, which would justify oversight after they get out of prison? Maybe I’m missing something?

I haven't seen the court's decision, but the article you link to doesn't exactly say that. It says the decision was based on the separation of powers, not the rights of the sex offenders, and seems to say that they can still be sentenced to lifetime parole, but that they will have to be sentenced by a judge not by a parole board.

I actually agree with this. The reason is that many states include far lessor offenses into the sex offender category. I know two people who have to register as a sex offender because they had sex when they were 16 and had a baby. The state of Wisconsin charged them both with a sex offense even though they got married and raised their child. 15 years later they are still registering.

I know someone else who at 19 dated a 16 year old. They are still married after 10 years. And he is required to register.

The reality is that for all of humanity outside of the last 50 to 75 years and in most of the world today teenagers get married. But here and now its punishable with a life sentence of wearing a scarlet letter.

If sex offense was limited to violent rape, or the age of statutory rape was lowered significantly then I would agree with you.

There is no evidence that an extended sentence for child molestation will stop them from molesting children once they get out. Recidivism rates for child molestation are over 35% and even more than that when you include other violent and sexual crimes. These are proclivities, not accidents or mistakes. Supervision upon release is the least demanding way to deal with the issue. The next best thing is to not release them at all.

The examples you site shows where the law is messed up. If the law is changed to accommodate these couples then it should be done. Some people just happen to be paired up very young and tend to have the best marriages.

i would agree that if they’ve been let out of prison, then they should be able to get on with their lives

that being said ....

we shouldn’t let them out of prison IF THEY’RE STILL A THREAT TO THE POPULACE

My point is actually that the sentence should be life in prison. They need to be removed.

When it comes to child molesters, it is obvious that there must be some on the Massachusetts Supreme Court, otherwise this wouldn’t have happened.
