Why Judge Aileen Cannon should dismiss all charges against Trump

It's been great fun watching the left spin the findings of Special Counsel Robert Hur. The NY Times led the way calling it "unequivocal legal exoneration." That is totally false. Hur proved beyond a shadow of a doubt that Biden committed multiple felonies. He willfully and knowingly mishandled, retained and shared classified information. Any and all claims of Biden's innocence hinge completely on his being senile. Hur did not say Biden was a "sympathetic, well-meaning, elderly man with a poor memory." He saidMr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory.” And as I said, THAT is why he chose not to bring charges. It almost sounds like Hur knew Biden might be faking it. And hey, Biden roundly denied his memory was failing. This could all be cleared up with the release of the recordings of the interview.

And there's the genius of Hur's actions. It sets the stage for invocation of the 14th Amendment.

Equal Protection refers to the idea that a governmental body may not deny people equal protection of its governing laws. The governing body state must treat an individual in the same manner as others in similar conditions and circumstances.
Here's former acting Attorney General Rod Rosenstein asserting that you can rob a bank and escape charges as long as you cooperate with the authorities.

.@RodRosenstein tells @JakeTapper that the difference between the Trump and Biden classified documents cases is that “President Biden fully cooperated and turned over the documents” and former President Trump didn’t. pic.twitter.com/D1WMpGkLfI
State of the Union (@CNNSOTU) February 11, 2024

That's complete BS, of course. Cooperation is not exoneration.

Because it’s very simple. Because there were NO charges against Biden.

There is a foreign aid bill headed towards the House. The House should add one additional sentence.

No, the house absolutely should NOT use the foreign aid bill as a political tennis ball, adding some fuzz to it and lobbing it back to the corrupt Senate.

The Speaker of the House should DO HIS JOB as fiscal guardians of the PEOPLE — recognizing that the US is an unacceptable $33 TRILLION in debt — and fail to bring the bill to the floor.

Johnson is going to put it up for a vote in the house. Otherwise he would have already said it’s DOA. I think the problem is that the rinos are telling him, if he doesn’t put it for a vote, they will vacate the speaker’s seat.

No, it is better for Trump is the judge just lets the case proceed but very slowly so it does not come to trial before he is sworn in again. If she dismisses the case, the persecutor will appeal and if he loses on appeal, find a way to refile with modified allegations. Once Trump is sworn in, he can pardon himself. (If, Heaven forbid, he loses, the judge can bring it to trial, hear the “government”’s evidence and at the conclusion of their case find Trump not guility. Such a finding would not be appealable and double jeopardy would kick in.) So far, this judge seems to be doing a great job.

I like your theory Stingray. However, I personally do not believe they will ever allow Trump near the Oval Office again. They have come too far and have too much to lose by allowing him to win. My opinion is that they stop him by any means necessary-no matter how obvious/no matter how blatant.

Nice theory, but that hasn't worked out very well for J6 protesters.

Let's see, some people were convicted and sent to prison for trespassing . Meanwhile, the woman in Portland who threw the Molotov Cocktail into a police SUV with 5 officers inside was sentenced to 33 ... HOURS of Community Service.

Sounds like wishful thinking to me. Yes it might be the proper thing to do, but the Uniparty wants Trump in jail.

I’ll be surprised if Trump wins the election. If he does, I’ll be more surprised if the Swamp lets him live to TAKE office. Hate being a Debbie-Downer, but I don’t think there is a limit to how much the Deep State - on BOTH sides of the aisle - hates Trump!

The Trump and Biden classified documents situations are not comparable — with the results in Biden’s strong disfavor.

Biden as a Senator and VP had no Constitutional authority to unclassify documents for his personal use.

Trump as President DID have the power of “classifying” documents, and indeed Presidential power (but not Vice Presidential) is the starting point for classifying documents, even if Presidents usually delegate the mechanics. Because he was President and Chief Executive, it was Trump’s prerogative to declassify documents. He also has the privilege of determining which of his Presidential documents he wishes to retain upon leaving office.

Biden is known to have distributed classified materials to third parties for private use, apparently including to support his son’s “sale of office” schemes.

Trump by contrast retained memorabilia but also some documents he felt he needed to have for his use as a former President beset for four years by political vultures. While in office, Trump publicly declared certain documents related to the Russian Collusion Hoax to be declassified, but asked Barr/DoJ to review them for privacy concerns then to release them to the public.

Biden left classified documents strewn willy-nilly: in an unlocked garage accessed by a known crack addict; in an unsecured office in a China-funded “think tank”; and, in a Chinatown warehouse managed by a Chinese national.

Trump by contrast stored his retained documents in a locked room within a guarded, highly secured compound.

When asked about the docs, Biden says he doesn’t remember about them. The position that Biden forgot the documents but was keeping the forgotten documents secure is nonsense.

Trump by contrast made it clear all along that he believed he had a Presidential right to possess the materials he retained. He returned documents to the archives that he deemed appropriate and seems to have been working on the rest. Trump could not form a conscious intent to violate the law when he believed the law and Constitution supported his position (as it does).

Apologies for going on and on...

Being a Judge and having good judgement are not always the same as many of them have proved.

As I recall Trump and his legal team were disputing the contrived partisan charges made by the National Archives which were blown up by the rogue FBI raid on Mar A Lago. Biden got caught red handed violating national security laws for personal gain. The judge should dismiss the charges based on selective prosecution.

I may be wrong, but if memory serves Speaker Johnson *did* say it is DOA.

Special Prosecutor Hur could have saved a lot of time and paper just by stating the obvious...

Here are X-Y-Z, the basic facts of a crime.

Here is political reality - no Washington D.C. jury will ever convict a Democrat of a politically related crime.

Two comments on that thought.

1) SO MUCH of what you pessimistic types project is based only upon what has happened in the natural realm. You fail to appreciate that the true power is in the supernatural (spiritual) realm. GOD is on the Throne and GOD has a several thousand year track record of raising up leaders and giving them victory in the face of overwhelming natural “odds”. With President Trump, we are already seeing this principle manifest — all of the lawfare against him is in the act of imploding in one way or another.

2) There are certain actions that the deepstate might take against President Trump that IMO would trigger a hot civil war. They know it, too.
