What are they, whats the legality of them, will they all count, and are they predominantly Kerry? We cant have the Democrats winning in court with these things!
A provisional ballot is one cast is a precinct in which the voter is not registered or on the current voter roles. This ballot was created after the 2000 election.
They are ballots required by the Fed gov that must be given out if the person who came to vote wasn't on the list but challenged and said they were registered. They get a provisional ballot and vote it and then that ballot gets checked later to see if the person was registered and entitled to vote, if they were the ballot counts.
If you go into a polling place to cast your vote but they don't have your name on the rolls you are given a paper or provisional ballot to cast your vote....it still must be proven that you are a registered voter before your provisional ballot counts.
I believe they usually involve people who have moved within the state and have not given their new address to the Board of Elections. They also could involve people who have married, changed names, didn't update their voter registration data.
And you expect a handful of this kind of ballot error in any state, maybe a possible few hundred at worst. If Ohio has 150,000 something is rotten in Dayton, or somewhere.
The law varies from state-to-state (MIchigan doesn't use provisional ballots- if you are not on the roll when you show up to vote, they register you on the spot and let you vote..... every wonder why fraud is so easy there?
Anyway, a provisional ballot is one cast in place of a standard ballot when the eligibility of the voter is in question - could be the voter is in the wrong precinct, or could be that the voter isn't registered. Another possibility is that the voter has no ID (some states require ID to vote).
Generally, provisional ballots that are cast by people who are not registered to vote don't count. The other cases vary from state-to-state.
Theoretically, the balance of the ballots should be fairly similar to the area's results.

Exactly...they will have to be verified before being counted. I know of several people who were not registered but decided to try and vote a provisional ballot anyway. The elections board supervisor told me that they would be tossed out if they could not be verified. I'm sure many of the ones in Ohio will not be verified either.
Earlier on Rush and Hannity republicans called in stating they had been dumped from the roles and were issued provisional ballots in Ohio.
No, it had to do with so many new registered voters. With so many new ones a lot got left off the lists. There were something like a million new registrants. Republicans and Democrats.
Not all the provisional ballots were cast by democRATS....plenty of Republicans filled them out.
The rats are claiming there are 250K provisional ballots, the election chairman in Ohio says no way that many.

In New York state they were called "affadavit ballots" (still are, as far as I know): you go to vote, your name's not there, and you complete a ballot, affirming that you're duly registered to vote in that precinct.
Some names are left off the rolls by accident, some people are registered but had their name changed, some moved within the jurisdiction but changed polling places, and others were added by a judge's order late, for some reason. All legal, and all reasons for a person to be able to vote, but not have their name on the list.
They look at your ballot afterwards, and if you really are duly registered to vote, they count it. Otherwise, the ballot is quietly disposed of, and you never hear that your ballot didn't count.
Most of the DEM provisional ballets are garbage !
