My first reaction was that he was not talking to his non-custodial child very nice, but we don’t know what she was bugging him about. Then I started wondering how his phone call gets recorded and on the internet. I thought you weren’t supposed to record phone calls without the consent of the caller. Maybe it’s ok in some states, not mine last I knew. So maybe the mother set it up? How do we know that’s really who it is?
If you commit a crime over the phone, or the person receiving the message feels threatened, AND the call was not intentionally recorded except on an answering machine, then there is no law broken.
Baldwin really stepped in it.
The moron put it ON HIS DAUGHTER’S VOICE MAIL.
“I thought you werent supposed to record phone calls without the consent of the caller. Maybe its ok in some states, not mine last I knew. So maybe the mother set it up? How do we know thats really who it is?”
It’s definitly Baldwin - he has acknowledged it. As far as consent to record, when someone leaves a voice mail message, they have given their consent because they know it’s being recorded. Once he was foolish enough to leave recorded evidence of his viciousness, Kim had him.
How did the message get on the internet? Several scenarios are possible. The most likely is that the child let her mother listen to it, 15 seconds later she was on the phone to her attorney, and it was suggested to her that it would completely vindicate her in the public’s mind if the recording “somehow” found its way onto the internet.
It is off an answering machine, not taken from the airwaves, so, it was recorded WITH his knowlege, just leaked without his permission.
