Marine biologist Nancy Black pleads not guilty in whale case

Well known marine biologist Nancy Black was released without bail Thursday after pleading not guilty to a host of charges related to her research with killer whales on Monterey Bay.

"This thing has been kicking around since 2006. If she was going to run away she'd be gone by now," said U.S. District Court Judge Howard Lloyd.

But Lloyd required Black to turn over her passport, submit to drug testing and face a $50,000 penalty if she doesn't make her next appearance Feb. 13.

What I would like to see is the Constitutional authority for congress to regulate whale feeding.

The Constitution is a list of enumerated powers given to the federal government by the states and agreed to by the people. If it's not there, they can't do it.

I'm missing the whale section in my Constitution.

Black, 49, is charged with two misdemeanor counts of violating the Marine Mammal Protection Act by feeding killer whales in the bay in spring 2004 and 2005. More serious, however, are felony charges alleging she altered a videotape requested as evidence in the federal investigation, then lied about it to authorities. Those charges carry a combined maximum sentence of 25 years in prison and $500,000 in fines.

This is what our federal government considers a major criminal. You see this? The actual crime is a misdemeanor, but the federal government is furious that one of the peasants may not have submitted properly.

Just incredible! Our Federal Government is totally out of control. The idea that anyone faces this kind of penalty for feeding anything is just outrageous. But then we have the EPA and their Gestapo ( The Army Corps of Engineers) doing essentially the same thing over “wetlands.” Never let your lawn sprinklers run too long or you may create a “wetland.”

The lesson here for everybody is this: don’t ever talk to the Feds (any federal agency) without a lawyer present..period. The big “crime” here is lying (or allegedly lying) to a fed.

The monterey county sheriff should be asking this question of the federal government. If he isn’t, it’s time to elect a new sheriff.

The lesson is the citizens need to disarm the feds from their usurped authority.

That is the true and effective remedy.

She would have been better off engaging in insider trading and destroying the evidence, like Martha Stewart did.

Almost no jail time.

Martha Stewart received NO jail time for insider trading. She was convicted of - you guessed it - lying to the feds.

True. She was not convicted of insider training because she destroyed the evidence. I can't remember the details but this is a nice summary from her appeal.

I liked this part the best,

There is no SEC rule stating that convicted felons may not be officers of public companies. But most publicly traded companies aren't likely to let a felon head the company, according to Solomon Wisenberg, a white collar criminal defense lawyer in Washington.
