Say Obama loses the election and then these emails that Gingrich are talking about surface. And then eventually the videos come out.
Obama has LIED to the American people just like Clinton. Even though he wouldn't be around can elected officials still vote to impeach him? Even though it wouldn't be knocking him out of office per se? Just a mark on his record?

If he is out of office, you don't have to/can't impeach him. Because of politics, he is unlikely to face prosecution.
Any person can be prosecuted for treason should there be evidence of it. However, if you try to prosecute a president or a judge while in office, the office itself acts as a protection since there are priveleges and connections that go along with it. That’s why it’s proper to remove an official from office and then prosecute.
For example, the president controlse the attorney general’s office and could influence the prosecutor, etc. The president could try to pardon himself. Out of office, these powers are removed. Likewise with a judge.
Who cares about impeachment? It means nothing, not even removal from office. He needs to be hung for treason; that would work for me.
It is too late to impeach the Obozo and his hate American thugs like Holder, Panetta, and H. Clintoon surrounding him.
Wouldn’t it be better, if Obozo was arrested for Treason and high crimes at Andrews AFB on his way back to Chicago after President Romney is sworn in.
Then, have mass arrests of his Chicago rat thugs for treason/high crimes and abetting traitors/criminals at various DC area airports as they try to flee back to Chicago and other rat holes. If we miss their out going flights, arrest them at their home airports when their planes arrive. Invite Fox to video the rats being arrested in DC or at OHare.
Panetta and Clintoon need to be arrested for treason and other high crime criminal acts.

Please understand I’m not commenting on Obama’s guilt or innocence of criminal behavior or any evidence that might be out there.
I’m saying, it will not be done. Obama will not be prosecuted. It takes a prosecutor to prosecute, either within the Justice Dept or an outsider who is appointed to do it independently.
I’m just saying the Republicans, from Romney at the top to the lowliest of House members, will not want to, and will not, pursue Obama criminally after he leaves office.

You keep using the word “impeached.” I don’t think you understand what it means.
The penalty is removal from office. If the person is not in the office, you can’t impeach him.

Yes, prosecution for treason applies to all the people, not just those in office. It’s specifically defined in the Constitution and requires two witnesses to the same act.

No, but he can be tried as a citizen for crimes he has committed. So, for example, if anyone produces concrete proof that he is Kenyan and not American, he can be tried for fraud and malfeasance.
THere are a variety of other scenarios that could sldo come into play but, IMO, if anyone successfully brings charges gainst him in civil or criminal court, it is most likely that he would be granted an Executive Pardon by the POTUS so that he could continue to be a pestilence upon our land.
The Congress only removed Hastings from office. They, for whatever reason, chose not to disqualify him for other offices. But they could have.

Prosecutorial discretion means that any prosecutor can decline to prosecute, for whatever reason.
The GOP will not allow a prosecution of Obama to go forward.

Would he have to allow Iran to keep one of our sensitive reconnaissance drones rather than retrieve or destroy it?
Would he have to subvert Congress and Federal Immigration Laws via Executive Order by refusing to deport illegal aliens, and also refuse to prosecute sanctuary cities for harboring illegal aliens?
Would he have to bar Arizona from doing background checks on illegal aliens the day after the SCOTUS deemed such checks lawful?
Would he have to fail to treat the takeover of sovereign land in Arizona by the Mexican drug cartel as an Act of War?

Would he have to draw-down security on the Benghazi embassy prior to 09/11/12 even though that Embassy had been attacked twice beforehand?
Would he have to REFUSE rescuing SEALs and our Ambassador under attack near our Embassy resulting in the deaths of four Americans because he was afraid a failed rescue attempt to negatively impact his campaign for President?
Would he have to resume campaigning in Las Vegas one day after a terrorist attack on a United States Embassy in Libya?
Would he have to refuse to meet with Bibi Netanyahu of Israel, concerning the nuclear Iran threat, while instead appearing on various TV shows including The View?
Would he have to say "The future does not belong to those who insult the Prophet Mohammed"?. Shouldn't our president be an ADVOCATE for free speech in America, instead of condeming it? Under Sharia Law it is illegal to insult the Prophet Mohammed, punishable be death. Which rule of law is Obama promoting here?
Well, he's done ALL of the above and suffered NO consequences let alone impeachment!
