Los Angeles County deputies raided the home of Eugene Mallory and Tonya Pate. Authorities claim they had probable cause to search the premises because they could smell chemicals used to make methamphetamine while standing outside the house. Police suspected Mallory of being involved in an illegal meth ring.
Mallory was asleep in bed when police entered his home. Pate said her husband has bad eyesight, and couldnt tell that the men entering the house were police officers without his glasses. The deputies claim that Mallory pointed a gun at them, requiring them to take defensive measures. They shot him six times, and he died.
Police found no meth, nor evidence of a meth operation, inside the house. They did find marijuana in Pates sons room.
The sheriffs department insists that the marijuana vindicates the raid.
There was a drug operation that was certainly going on in this house, said Whitmore.

Story has been posted about a dozen times on FR. I know it just happens due to the nature of the forums — just saying — leads one to believe that cops are shooting innocent seniors, dogs, children, paperboys and anything else looking suspicious every day.
Why do cops always have to carry guns? It should be quick and easy .... police shoot and kill somebody under dubious circumstances should at least lose their right to carry a gun for 2 years minimum. No appeal, no union representative. Automatic law enforced by the police IA.
Other articles claim police found marijuana growing equipment and marijuana in the house. Police had obtained a narcotic search warrant. Police say the man came at them with a gun.
As of yet, only a slight exaggeration.
This particular story was posted on DC today; I did a search and didn’t find it. Maybe some Freepers did not see any other articles about this that have been posted in the past.
What’s that smell?
I don’t know what the facts are in this case, but a lot of people in CA are allowed to grow enough pot for personal medical mj in CA. I’m not defending that, but how did it go from smelling meth to finding pot and how would that merit shooting someone to death in their house? If someone busts into my house and I don’t realize that they are police thugs and I grab my weapon to defend myself, then death it is?
It’s just tricky. Generally a juicy tidbit like this one from 3 months back would have surely been posted on FR, But you never know. I would have put the date of the incident in the title.
This kind of statement is so tiresome to read. I see it all the time on FR, and it doesn't strike me as being something one would ever expect to happen. Has anyone ever heard of a police officer being personally sued for this sort of offense? I'd like to know.

I was simply relating what other articles were saying on this topic. There is a huge discrepancy between what the Police are saying and what the wife claims.
There are articles out there that say there no drugs found in the residence where the shooting occurred, but rather in a trailer on the property and that the marijuana that was being cultivated was for medicinal use by the son of the surviving wife.
The wife claims he was shot in his bed. The police claims he pulled a pistol out and pointed it at them.
It does not sound like there were any witnessed to the shooting that were not cops other than the man that was killed.
One way or another they would have found something illegal in the house to justify the raid

It is just scary to me that if a person is in their own home and grab a weapon to defend themselves from what they think are intruders, and the intruders are actually police, the police can have the right to shoot to kill immediately.

Ya hear these kinds of stories all the time now. The American police are not to be trusted. They seem to be trigger happy with either the incompetence of not knowing how to employ any other defensive or offensive tactics besides shooting people dead, or are just gangsters with legal license to take out their hostilities on anyone they might encounter. Some could just be wimps whose fear overrides any other instinct that an otherwise brave and capable cop who knows they are there to serve and protect might have.

Any doubters as to the fact we ARE living in a police state? This is the way it starts. And if nothing changes will only get worse.
Yeah, but they got their rocks off by shooting the 80 year old man six times. All in all, from their point of view it was a success. Back when we had police officers instead of kill happy thugs with badges, this would have never happened. But that was then when the police were respected and gave respect and this is now when the police are to be feared and avoided.
