Sued for $10m over tree that is 'destroying' neighboring Manhattan brownstone owned by Marisa Tomei’s parents

Gary and Addie Tomei, the parents of Oscar winner Marisa Tomei, are suing their neighbor over a tree in his yard whose roots are destroying their home The neighbor is Sean Lennon, son of John Lennon, who purchased the home on West 13th Street in Greenwich Village six years ago for $9.5million

The Tomeis say they contacted Lennon a year ago about removing the tree, and that he never responded, so they are suing for $10million They claim the roots of the 60-foot-high ailanthus tree have destroyed their home as it warped their foundation and compromised basement walls The Tomeis previously had to move out of their home early last year after a pipe burst in Lennon's home, forcing them to move in with their daughter They purchased the brownstone in 1994, and rent out a duplex for $9,000 a month in the residence

The parents of Oscar winner Marisa Tomei have filed a lawsuit against the son of famed musician John Lennon.

Gary and Addie Tomei are suing Sean Lennon claiming in the six years since he purchased the property next to them, both located on West 13th Street in New York City's Greenwich Village, he has refused to cut down a tree in his front yard whose roots are now destroying the Tomei home, this despite numerous requests from the couple.

As for damages, the couple are asking for $10million - and that the tree be removed.

According to court documents obtained by the New York Daily News, the Tomeis are claiming the 60-foot-high ailanthus tree which grows in Lennon's front yard has 'compromised the basement wall and interior ... (causing) irreparable damage to the structural integrity of the building.'

Hmmm. I guess I would just sneak over in the middle of the night, band it, let it die and then wait for him to sue me. I would then counter claim. My guess is that he is too stoned to even notice.

I don't know what the law says about such a situation but this sounds kinda dicey to me.But if a reputable structural engineer (or,better still,several of them) decide that that tree is,in fact,causing serious damage to that home then one could argue that it's up to Lennon to address the situation.

Wouldn’t it just be cheaper and easier and take less time to rent a backhoe and rip up the yard and remove the roots from their property?

I would say there’s a good chance that’s what they really want.

Nothing will be done about the tree, because they are more important than people.

There are some kinds of trees that are notorious for their invasive root systems. It’s likely that this ailanthus “Tree of Heaven” did some damage.

I know that I foolishly let a foreign garbage wild tree grow next to my house for a couple of years. It was pervasive and prolific in its growth. Even after cutting it off at the base, it would sprout new growth immediately. I finally had to get my B&D Black Maxx right angle drill and 18 inch long 1” boring bit and drill three holes in the top of the cut off base. I think poured straight Roundup down the holes and repeated until the whole gallon was gone. That sucker was then Dead Right There.

I think the parents of Tomei are probably using the amount of the suit to make this fool do what he should. At least I hope that’s what they are doing.
