Supreme Court Justice Kagan uses Dr. Seuss in case argument

When the Supreme Court announced its decision Wednesday on whether a fisherman should be charged under Wall Street regulatory laws,

Justice Elena Kagan decided to include an unusual judicial argument: Dr. Seuss.

In 2007 in Florida, law enforcement officials confronted fisherman John Yates, saying he had caught several red groupers that were too small. Mr. Yates then tossed the fish overboard. But he was charged under the Sarbanes-Oxley Act, which sought to punish the destruction of physical evidence in wake of the Enron scandal where accountants shredded thousands of documents.

In a 5-4 decision announced Wednesday, the Supreme Court ruled that the law was meant to apply only to records or information documents.

But in her dissent, Justice Kagan argued that fish should be included in the “tangible object” category of evidence the law describes.

“A fish is, of course, a discrete thing that possesses physical form,” she wrote. “See generally Dr. Seuss, One Fish Two Fish Red Fish Blue Fish (1960).”

I am not a fisherman, but I thought that when you catch a fish that is too small, that you are supposed to throw them back...

Yes, you're supposed to throw them back right away. Alive.
If you wait until you're caught, then it's to late. Then they are evidence.
If the fish are dead then there's no point throwing them back.

A business contact of mine had a spouse who worked as a nurse in a New Jersey hospital.

She said that the hospital administration, and just about all the staff, were fawning over this new doctor who was hired because he had graduated from Harvard.

“oooooohh......Harvard!” They were swooning all over him.

Except that it was not long before is wife, and all of the other nurses, were finding that they were spending all of their time running around the hospital trying to correct his mistakes.

“This guy is a friggin’ idiot! He’s gonna KILL somebody!”

Harvard is a re-education camp, and a social club, all in one.

You get out of there with your mind right, and you are now connected to all the right people.

They take care of you, give you a place to land when you are thrown necessarily under the bus (Jay Carney), and they work to conceal your indiscretions (while, of course, documenting them).

Princeton used to churn out quite a few good young officers, once. The idea was that business owners would send their sons, get the education, serve their country, learn management, logistics, accounting, and strategy, then come home to take over the company from their fathers.

Worked for a long time.
